Haha. No.
in a heated argument, no contact made, its hard to make that case that Hayes wasn't the initial aggressor in that scene. but i'm just a smart dude with no legal background.

his leads me to believe that someone in the smith camp was threatening with a gun. they all say nothing about anyone having a weapon or mentioning a weapon but the witness on that recorded video at the scene describing what happened talks about both men talking about guns.
the prosecution is trying to paint the story as Hayes just ambushed with the gun. JMO

If that is the case, it makes it pretty easy. Ballgame.
Is the 911 tape going to be played for the jury?
I'm sure it will be. The 911 call was made by an off duty police officer who left the Half Moon, and walked towards the scene. He asked Cardell Hayes what happened while he was on the phone with 911, and you could clearly hear that statement made.

This is absolutely what Hayes should have done
Just like Smith shouldnt have driven drunk
And then shouldnt have hit and ran

Hernandez said the Smiths, he and his wife were only at Sake Cafe with Pierre Thomas, others for 20-30 minutes before drive downtown.
not likely will took 8 shots in 20 minutes.

Do you have anything to support the above being enough justification to shoot someone?

I think the disconnect in this thread is that some people are arguing about what they feel should be the right way to handle the situation as it is happening versus the people who are arguing the semantics of what makes the actions legal or not...
Hope that makes sense, it did in my head

Hernandez: "I never once lifted my hands up. I never once took a swing at him. He took a swing at me. He swung so hard he lost his balance."

The alcohol doesn't really interest me although I know you guys love to make a big deal of it.
He was drunk. He shouldn't have been driving.
So what? Even if he's drunk out there screaming at Hayes, it isn't particularly relevant.
