I mean it does matter to a certain degree, especially if it was Hayes (because he wouldn't be able to argue certain things).
But its all about REASONABLNESS of response, reasonableness of fear of losing your life, and reasonable actions taken to prevent that.

That doesn't disprove intent as far as I'm concerned. Maybe he decided he was going a little too fast. Maybe he chickened out at the last second. Both perfectly reasonable.

I would certainly want to make the argument that stand your ground wouldn't apply to him because he was in the commission of a crime.
I don't know the case law on this at all. So it could have been tried before and shot down. I guess it depends on the definition of "commission of a crime".
