Actually,this is the strategy. Nobody sees anything then it is entirely on Hayes' testimony. He only needs 3 people to buy his bullshite.

One said he saw hand checking with Smith as the aggressor and Hayes on the defensive
One also said Smith did nothing that deserved to be shot, but he admits he was focused on Hernandez and not Smith leading up to the shooting

Hayes saying that Smith actually got a shot off is what's going to send him to prison if he is convicted. They should've just left it at he said he was getting a gun and he walked to the vehicle.

I refuse to believe one person, and one person only saw what Hayes is testifying to, Hayes himself. There have been too many other people around who testified differently. His version is the outlier and is conveniently exculpatory.

Saying Smith shot first and missed is so stupid. How did he shoot at Hayes and get hit in the left side under his armpit if he was shooting at Hayes?
