Your insurer, is subrogation into your rights against their insurer. Basically they take your place, That happened when your insurer paid you for the incident. The other drivers insurance doesn’t know that you’ve been paid yet so You need to forward that to your insurance and just stay out of it but send everything to them.

Threatening valid legal action is not extortion. You can say we can settle this for 50k or I’ll sue. If it’s a valid lawsuit that is not extortion

Yes, let your insurer handle everything, including payment to you for property damage to your car and subsequent Subrogation, for everything they pay you, against the other driver's insurer. Your Adjuster might be able to provide more detailed info as to why the other company is denying the claim. If your company does subrogate, it will be adjudicated through Arbitration Forums (strictly an inter-company process). There are several possible reasons why the adverse company is denying...it could simply be that your company already paid you and they'll be willing to settle a Subrogation claim from your insurer.

Did your vehicle have prior damage in the same area as that caused by this accident?

Was there paint transfer from the other vehicle to yours?

Does you company have a statement from a witness who saw it happen? Maybe same person who got the plate number?

Was your wife alone?

Was your wife hurt?

That wasn’t the statement. It was “do this or I’m calling the police.”

Substitute “call your insurance” with “give me 1200 for damages” or you’ll call the police. Is it extortion then?

That literally never happens. You sue. Period. They can chose to settle as a result of the suit.


You never hear of them settling with no suit.

The problem with this……it isn’t the scenario in question. You haven’t proven the person you are talking to is the one guilty.

Your insurance company may have decided not to pursue subrogation since it was $1500 of damage. Assuming you have a $500 deductible, they’re out $1,000 and the back office admin might not be worth it.

Odds are your car rental will cost more than the repair. Did your company pay for that?

These dudes just said you going to the cops to report a crime that was committed is extortion.

They have said some dumb shite over the years but this is pretty top and why guys like slow shouldn’t be taken seriously.

Their insured made a fraudulent statement denying the hit so that’s all they have to work with. Tell them you have third party witnesses. State Farm is the most difficult company to deal w when you are going after them.
