re: Why do “squatter’s rights” exist? It’s beyond messed up.

Can't you just hire somebody to move all their shite out and say you don't know what they are talking about b/c they aren't on any kind of lease? How would the squatter be able to prove they lived there?

Reminds me of Katrina evacuee Theon Johnson (NYMag.com).

quote:

But thanks to the city’s squatters-rights law, evacuees here were safe. Their rooms weren’t paid for, but since they’d been in them for more than 30 days, the hotels couldn’t just kick them out. Only a judge’s order could evict them.

And Johnson, 49, isn’t that motivated to leave. For one thing, AMC’s in the middle of its “Thrill Me” marathon. Next up, Gothika. “Halle Berry,” he says with lazy lust.

quote:

After being flown here for free back in September, Johnson’s been at the Holiday Inn since Super Bowl Sunday. On April 21, the hotel served Johnson with three notices of occupancy termination, saying that it would begin court proceedings if he wasn’t out by May 9. He wasn’t, so it did. If the court boots him, Johnson could end up in one of the city’s homeless shelters. He’s been broke for over a month now. FEMA sent him $9,000 in housing aid, but he spent it all on booze, cigarettes, some clothes, and food—partying, mostly. “I spent my money just the way I wanted, and I think [fema] should send me some more,” he says.

I wonder if ol' Theon is still at the Holiday Inn watching Halle Berry movies.

Some of these squatters do this for a living, or at least for a place to live, they know the law very well.

It's usually multiple people, so my guess is to answer your question, they probably always have one of them at the house to safeguard against that. But yea, if no one is home, get rid of all of their shite and play dumb. I could be wrong, but I imagine that's a solid plan. but they also know that, so they probably keep someone at the home at all times and just call the cops immediately if you show up.

This is why you take care of things yourself instead of calling the cops.

Or feed them some of that shitty food you cook.

I know we have delusions of grandeur and it's easy to make a lot of claims on a message board, but the reality would more than likely be entirely different than folks think, and not in their favor.

You sound like a total pussy who would wait 7 months to evict a squatter.

Legally, they can and you’re not allowed to throw them out

You can, you just need to give the person due process through an eviction order. Those can take a while.

What you cant do is physically throw them out.

I wouldn't even ask questions or get the cops involved. I would simply walk in and get my gun, if they refuse to get out I will shoot them and say it was self defense.

. You have to go through the eviction process to legally remove them from your property.
Or you can go down to hood and hire some thugs to relocate them for about $50. Might also need to retain a dead body disposal crew though.

The idea of squatters rights is to put property back in commerce rather than have it sit and doing nothing. I think that’s the theory, anyway.

Yep. Step one: call 911. State your address and that you returned home and the door is ajar; there is someone in your home. State "I believe they are armed, oh my God they are coming right at me!"

Step two: hastily hang up phone mid-scream.

Step three: shoot every single squatter until they stop moving.

Step four: sit on front porch unarmed and with hands visible until cops show up.

Step five: in any castle doctrine state, you aren't charged. Sue the families of said squatters for PTSD, pain and suffering. Call serv-pro for clean up. Remodel with the new cash.

Step Six: Profit.

If you leave on vacation and someone breaks into your house and stays there for a week, you can ABSOLUTELY kick them out with whatever force needed. That is not how squatters laws work. Thats called breaking and entering / trespassing.

Can anyone explain to me a logical reason for a squatter to be allowed to stay in someone’s home that wants them out?

the op house was an uninhabited rental home and not his primary residence. Squatters laws don't generally apply to any homeowner's primary residence. There's a lot of mix up in this discussion.

^^

But it has been entertaining watching people imagine bums breaking into their house and setting up shop.

Sounds like a GREAT sitcom
