For one, the statute of limitation in Louisiana is only one year. While most other states are two or three years.

The problem, though, is that for every “Bob” who is legitimately injured, there are 10 “Bobs” who aren’t. But they know that if they go get the right plaintiff attorney and go to the Dr who the plaintiff attorney “recommends”, then that Dr will say “oh yeah, he’s got some soft tissue injuries. Needs physical therapy. Maybe a chiropractor.”

So uninjured Bob decides that even though it’s kind of a pain to go to physical therapy and chiropractic treatment, he’ll do it because his lawyer tells him it will be worth his while. Of course the physical therapist and chiropractor will say he must be hurt- his flexibility is limited, he complains of pain, this sort of accident “could certainly cause these types of symptoms” and according to Bob, he “wasn’t havin this pain before the accident.” He starts off going 2 or 3 times a week, but then doesn’t want to deal with it as much. So he reduces his visits to once a week - enough to still be considered “treating.”

Finally, after 9-12 months, Mr Plaintiff Attorney demands $45,000. Why? Because he’ll stipulate that his clients damages are less than 50K to ensure that the Judge, whose campaign he generously contributes to, will hear the case, rather than a jury that might smell the B.S.

Attorney has now made his 15K for doing virtually nothing and uninjured Bob now has 30K for just a few trips across town, which is likely more than he makes in a year.

See how great the system is???

FALSE. The absolute worst aspect of this state is the people who comprise it. I say this not only as a native and resident of south Louisiana but also someone who works with customers from across the entire country. I can say without a doubt or any hesitation that my Louisiana customers are the rudest, angriest, most entitled, biggest pains in the arse I deal with every day. People who say Louisiana is full of the nicest and kindest people in the country have never worked with people from other areas of the country.

This is it, been saying it for a few years now. The politicians, injury attorneys, litter, shitty roads, etc... are all symptoms of the problem you just laid out. Until people take a look at themselves and fix what they can, nothing will change.

It’s not a personal injury attorney thread until Motorboat joins. Now we get to hear why tort reform isn’t needed and how it has nothing to do with companies not wanting to be here.

I was talking about the lawyer, not the client.

If they weren’t the cause of the wreck, shouldn’t they be entitled to money, especially of the person responsible has shite insurance? But I do agree the ambulance chasing here is much more oversaturated than in other cities I’ve been in.

Drive I-10, I-12, I-110, I-20 etc and count the ambulance chaser billboards. All big downers to the current administration running the state that killed the insurance Reform bill last session.

I can assure you that isn’t the case. A hard day of work would kill half of these yankee bums I’m talking about.
