I've accumulated a lot of otherwise useless trivia through the years (though some might help on "Jeopardy") and here is one for ya:

Despite the Miranda warning, you have no right to "remain silent". Your silence may in fact be used against you.

You must "invoke" the right, presumably by speaking, unless you perhaps can prove that you otherwise communicated your intent to exercise your rights. This is a product of the courts bending over backwards to twist every nuance in favor of law enforcement and against the accused.

Yes you do. In criminal matters, police officers/detectives cannot compel you to speech.

You keep your damn mouth shut.

Literally NOTHING good can be gained and plenty of bad.

Yes i did, and get this…it was from a commanding officer. Backstory…i worked in a prison for a few years during college and an inmate in solitary confinement claimed that several guards were constantly harassing him (violating his civil rights) So much so that the accused guards were called in to question by internal affairs for the Sheriffs office. As soon as i enter the room I’m mirandized. I think that it was a scare tactic. I didn't do it and refused to rat on those that did. Just kind of odd wearing a Sheriffs uniform while being mirandized.

He’s correct that there is a SCOTUS ruling that you have to affirmatively invoke your right to remain silent. At this point, I advise people to invoke their right to counsel instead of invoking their right to remain silent. Invoking the Sixth Amendment has more teeth under current jurisprudence.
