What's the law on what you can do if you catch someone breaking into your car?

My car was broken into last night. Nothing was taken and the alarm didn't go off so I forgot to lock it, so that's on me. But if the alarm were to have gone off and I catch a guy digging through my car, what am I allowed to do? I'm not exactly inclined to just blow the guy away from my porch but I don't like my odds for him to not harm me in some way if I alert him that I've caught him. Has anyone on the OT been in this situation and what are your thougts on what you should do? My ultimate reaction is if you're going to break into someones car, you better be prepared for him/her to open fire on you to protect their property.

No, I live in the wild west. But tourists sometimes call it New Orleans.

I caught one and chased him for three blocks. But damn I couldn't catch a crack head. He busted a window and stole a cell phone charger.

there's a lot of gray area. Even if you're legally allowed to shoot him you'll spend 10s of thousands defending yourself in court over some loose change and a pair of 10 year old oaklies

If you shoot someone in NOLA for breaking into your car, you'll probably go to prison and get sued by the perp's family

There are nuances to this depending on the State you live in, but generally speaking you can only use non-lethal force to protect an interest in property.

After my incident I kept a paintball gun with pepperballs near my door. Not sure if legal but would make me feel better to use it on a thief.

You mean your car door was opened?

It wasn't "broken in to"

Calling the police over something like someone breaking into your car is as useless as a used condom. They are not protecting and serving anyone from what already happened and they dont waste their time trying to catch who did it..

Politely ask them to stop, but make sure it's in a way that's not hurtful from a socioeconomic standpoint, i.e. implying that you're better than them because you "own" the property in question.

Move out of New Orleans.

Problem solved.

My uncle had his car stolen near Lakeview while he was helping my cousin move into his new house. Two urban youths who took the thing for a joyride for a few blocks then ran it off a curb into a ditch and fled when they came across some cops.

Insurance is refusing to compensate until they find out more details from NOPD, who are dragging arse on the case (this happened back in October of last year and is still unresolved).

Long story short, frick New Orleans.

I'd call 911 before going outside, then have a shotgun held on him. If he comes at me or appears to have a gun or knife I am shooting. If he takes off running I'm not shooting and having to deal with years of criminal/civil court over anything in my truck. Now if he's attempting to get inside my house he's taking buckshot to the belly.

A lot of insurance companies won't believe you had your shite stolen unless you have a police report
