It's a burglary regardless of whether anything was taken, and no, you may not use lethal force solely to protect property.

There is no gray area in the OP. In Louisiana you can't stand / sit on your porch and shoot someone who is rifling (no pun intended) thru your car. Texas is the only state in which you might be able to legally do so - and IIRC it has to take place during the hours of darkness (Plus there may be a few more qualifiers - talk to a Texas lawyer who practices criminal defense).

In Louisiana you can use deadly force only when you reasonably believe that you are in imminent danger of suffering death or great bodily harm - and you must be an innocent victim. And "reasonably believe" means that the jury thinks your actions were reasonable.
