Not necessarily imo. If you damage it then definitely so. But if a part or something gives out while you have it then I'm not sure you're automatically liable. Ex - if I lend say my pressure washer to a friend and the beat up rotten hose finally breaks thru while he's using it I wouldnt expect him to buy me a brand new one.

They were handed a piece of perfectly operating equipment with specific instructions they agreed to. shite was returned broken then stolen because instructions weren't followed. Use logic

Next time this happens, instead of pretending it's stolen, just mail it to yourself but be sure to get insurance on it.

Then just claim that it was delivered broken and you can collect the insurance!

As long as you don't have a pesky mailman neighbor, you should be fine.

Just remember never to loan anything you can't afford to give away. Whether it be items or money. Good chance, you won't get it back.

Absolutely they are at fault. It sounds like you are lending an object for their sole benefit.

They have a high standard of care with your equipment and will be liable for the damages/conversion to it.
