If I loan you my penis and you give it aids, is it my fault?

Touche. Your analogy has changed my perspective on the matter.

quote:Not necessarily imo. If you damage it then definitely so. But if a part or something gives out while you have it then I'm not sure you're automatically liable. Ex - if I lend say my pressure washer to a friend and the beat up rotten hose finally breaks thru while he's using it I wouldnt expect him to buy me a brand new one.
If you break something that is in your possession, you must repair or replace the damage. End of story.

They were handed a piece of perfectly operating equipment with specific instructions they agreed to. shite was returned broken then stolen because instructions weren't followed. Use logic

Yea it is their fault and they should be buying you, I mean your friend, a new piece of equipment.

Someone broke the handle on your yeti then it got stolen - Huh ?

1. Someone stole broken goods?
2. How do you know they actually returned it?
3. I think your friend pawned your equipment and didn't want to own up to it.

Next time this happens, instead of pretending it's stolen, just mail it to yourself but be sure to get insurance on it.
Then just claim that it was delivered broken and you can collect the insurance!
As long as you don't have a pesky mailman neighbor, you should be fine.

Yep. Good chance he never returned it. Or he or someone he knows went back and got it.

Just remember never to loan anything you can't afford to give away. Whether it be items or money. Good chance, you won't get it back.

They'd be buying me a new whatever it is

Am I the only one who realizes this is copied and pasted from Gravy's facebook?
tke857, did Gravy sit on a piece of your equipment and break it?

That's why I said, "If you break" - not "if it gets broken".

Yeah, they are at fault. That's pretty fricked. That person certainly would get no more favors from me.

Absolutely they are at fault. It sounds like you are lending an object for their sole benefit.
They have a high standard of care with your equipment and will be liable for the damages/conversion to it.
