You have to pay the gift tax to the IRS or go to jail.

Pretty standard thing on the IRS separation of marital property form your attorney is required to submit.

Well, according to Louisiana law, as long as the ring is less than a certain amount in value (it's pretty high), it's not counted as part of the community property in the divorce and the wife keeps it. If it is over that value, it's value in excess of that amount is considered part of the community property that must be partitioned.

This is because the engagement ring was considered collateral offered to ensure the man followed through on his promise to marry. Back in the olden days, a woman who was betrothed, but broke the engagement, was considered to be "damaged goods". So, if he broke the engagement, she could keep the ring. However, if she broke the engagement, she had to give it back.

Once they're married, though, she is seen as having gone through her end of the bargain, so the ring is hers.

I got engaged and disengaged before marrying, butvI definitely got that ring back.

I got mre for just the stone than I could the ring for whatever reason.

The new girl gets a new ring and mattress. It's courtesy.

Before marriage, the engagement ring is a "contract," if not given on a gift-giving holiday such as Christmas. If she backs out, the ring is returned.

I believe pawn shops are the ultimate destination for most, and the majority of those might go through disassembly and melt processing.
