Yeah I’d say that’s pretty likely. It’s now all about how his constitutional rights have been violated. That’s Brooks last stand.

The bailiff and IT guy are testifying now to say Brooks is full of shite about not being able to hear

Brooks should be continuing his bluff here instead of demonstrating his ability to hear by asking questions and communicating with the court

What happened to cause the judge to say he forfeited his right to testify? I, of course, had a meeting at the start of court today so missed it all. Should I go back and watch or will it just infuriate me?

You didn't miss much. He refused to answer whether or not he had any other witnesses, then refused to let the judge complete her colloquy to make him aware of his right to testify/silence. So she gave him one more chance, he still refused, and she declared his defense rested.

He was unresponsive and acting like he couldn't hear. That's why the IT and the Sheriff were there testifying that he could in fact hear (and speak in the mic)

The judge asked him multiple times if he had a witness to call, he refused to answer and pretended that he couldn't hear. Then she read him his right to testify, etc and he refused to answer.

Thanks. That explains why he is acting like he couldn't hear. I'm disappointed his mom didn't show up and he didn't testify. I can't wait for his closing argument tomorrow, he's 100% going to cry and make ridiculous arguments about subject matter jurisdiction.

I have never seen any judge or courtroom be as patient in allowing what she has. I think they should have been even heavier handed with him than they have been up to this point. There is no reason to allow him to do what he has been allowed to get away with. He deserves the smackdown he is about to get. He kept pushing and pushing and obviously thought he could run the courtroom.

She is being overly cautious to make sure they don’t have any chance of doing it again. She also is making sure to appear fair for when she launches him at sentencing.
