I know of two ditzy babes who have bragged about getting banged behind the akasha dumpster in tigerland in the past 18 months with no actual recollection of the event other than what they were told.

Consensually drunken Dumpster bangs outside of a bar happen all the time.

Are there instances where it's more regret than rape? Yeah, I think so. And men don't get the benefit of the doubt in those situations and I'm sure many a life has been jacked up because of it.

This, however, is not such an instance. Dude just rolled up on a passed out girl. There is no grey area. They weren't flirting and maybe it went too far. He just happened upon an opportunity and thought it was ok to do what he did. That's a rapist, in my book.

I think you need to look into who the judge was for the Vandy case.

The kid went to Stanford, probably had a high profile dad who wrote some checks, and not to mention the judge is a Stanford alum.

Unfortunately that's how our world works.

I think it has more to do with

1. Classism
2. California vs Tennessee
3. Multiple people/videoing it vs one guy.

It isn't race, geography or classism. It's money. There are two justice systems in the U.S. The one for poor people with an over burdened public defender representing you and the one for wealthy people with a team of highly paid private defense attorneys who golf with judges and DA's, private investigators, expert witnesses and teams of consultants to help with jury selection, mitigation, etc. Fact.

I wonder why a female who is legally drunk is deemed incapable of being able to decide she wants to have sex, but a male who is legally drunk is considered rational enough to make the same decision? In fact a drunk male is supposed to be able to tell when a female is too drunk to be able to consent to sex.

What is a 23 year old female's responsibility when it comes to drinking with a 20 year old male? Aren't there laws against providing alcohol to those too young to drink alcohol?

Could those possibly be mitigating circumstances in the case of Turner?

You make a good point about the inconsistency RE: alcohol consumption and rape cases. But you have chosen entirely the wrong case to make that point.

Yes, in some other cases, men who consumed alcohol may be unfairly considered the aggressor and even convicted of rape when their partner was equally or less inebriated... but that's not the case described in the Stanford swimmer assaulting a drunk woman.

From what seems to be in evidence the dude behaved like a sociopath and assaulted a very vulnerable person because she was vulnerable. The fact that his victim behaved like an absolute imbecile and put herself in danger with her reckless behavior doesn't make his assault any less criminal.

Someone correct me if I am wrong,

but I thought the Stanford case wasn't an actual rape, but in fact a sexual battery/assault?

In other words I don't believe he inserted his penis, I thought he just inserted fingers?

that would be a big difference between the two cases

I thought they had been drinking together? Did he really just randomly find her?

To be fair, the Stanford student was never accused of nor convicted of rape. It's kind of comparing apples to oranges.

With that said, 6 months is not nearly enough time to serve for what he was convicted of.

Not everything is racism. One is convicted of rape, the other got convicted on sexual assault if I recall (didnt really pay attention to either). Stanford dipshit should've gotten 4-10 years IMO, but DA decided to pursue sex assault charges probably because not enough evidence for rape. Again, I didnt watch much of the proceedings. Secondly, what is the Vandy's prior criminal history? Not enough prior criminal history information to rule out that maybe this was a 3rd offense type situation and therefore received a harsher sentence.

He hasnt actually been sentenced yet, so we dont know what he actually got.

in the cali guys case you could say he got 6 yrs-16 yrs, but in reality he got 6 months with 6 yrs probation

This is more a product of two different judicial systems/punishments and state prison problems, not race. But lets proclaim its white privilege and discrimination

The cases aren't really alike at all, in terms of evidence.

Yeah this wasn't a black or white issue.

More of a green one, really.

Rubbish. This is another example of a very poor decision by a judge. Happens every day with cases from rape to environmental law. You can call it judicial overreach, dereliction, or plain stupidity, but "classism" isn't a big factor.
