This white guy is being painted as a vicious rapist for fingering an unconscious girl he was either walking with or not (couldn't determine that from what I read). They Had been partying together.

The black guy raped his victim in front and back and lots of other vile shite.

Whoa wait a second. This is damn near as bad as the comment left by Poodlebrain, and is without a doubt victim-blaming. Everyone on this board has gotten drunk before at a party, but getting sexually assaulted outside of a dumpster is not a reasonable consequence we have to consider. She didn't put herself in danger with reckless behavior - she got drunk and a sociopath put her in danger.

There is no "yeah, the guy is wrong, but..." in these kind of cases.



You have the weight of knee jerk sentimentality on your side but you are wrong. Victim blaming is wrong if it used to exonerate the guilty, excuse a crime (say functionally the person deserved it), or shame a person who did not behave badly.

None of those things were in my statement.

Yes, it would be a stupid and bad thing for people to put themselves at risk by drinking to the point of unconsiousness. That is behaving like a reckless imbecile. Simiarly it would be equally stupid for me to wander into the french quarter late at night, alone, and drunk to the point of defenselessness.

Would it be victim blaming to point the finger at me for my behavior in that case? Yes. But it would not be unfair or bad for me, as an individual, or us, as a society, to understand my behavior was stupid and irresponsible.

If I were raped or killed it would not mean my rapist or killer was not guilty or had mitigating circumstances on their side. That person has their own moral agency and responsibilities to society.

She got so drunk that she passed out by a fricking dumpster. Give me a break. She should not have let herself get to that point. However the dude is a total loser for taking advantage of her. He should be put behind bars for years and years. She should also be held responsible for what happened to her.

Victim-blaming just gets to me in a situation that is well within the normal behavior for the majority of college-aged adults. I understand your sentiment, I do, but she wasn't walking alone drunkenly through some terrible part of town. She was with the guy, ended up being assaulted behind a dumpster, and woke up hours later. I don't believe getting drunk at a party is behaving like a reckless imbecile.

Getting blackout drunk is behaving like a reckless imbecile. Many people do this and get away with it. No one who does so deserves to be raped or murdered. But everyone who ever does it should understand how profoundly stupid and careless they were with their own safety.

If you have a daughter and you don't warn her not to be careful with her own safety by avoiding incapacitation then you have failed her as a father IMO. But to each his own.

I do, and when the time comes, I will, but I'll never concede the idea that God forbid they're incapacitated and a sociopath rapes them that they're an imbecile for drinking too much. It will always be about the sociopath, the criminal.

ETA: In essence the idea is that as a woman, you shouldn't get drunk because you might get raped, and if you do get drunk and get raped, you're an imbecile for letting it get to that point. I just refuse to accept that as realistic consequence of getting drunk.

Well, in that case they were acting like an imbecile and it wouldn't have been as likely to happen if they hadn't behaved in that fashion.

Criminally they only liable person is the person performing the assault. Morally the person who was careless with their own safety was responsible for putting themselves at risk.

ETA: you keep moving the bar from blackout drunk (or incapacitated) to merely having enough to drink to be considered drunk. You are having a conversation with yourself on that issue because you prefer not to admit the moral agency (and responsibility to themselves) of a person drinking to the point of incapacitation.

I'm not there, I'm sorry. Blacking out at a party isn't being careless with your safety UNTIL you're raped. She didn't pass out behind a dumpster because of her drinking. She was drinking, was lead to the dumpster, passed out, and was assaulted.

We can set the bar as black out drunk or regular drunk and my opinion doesn't change. It also doesn't take much to go from drunk to passed out for some people, so sometimes there isn't much of a difference.

Completely different circumstances. She's wasn't trying to do something she physically cannot or should not do. She wasn't doing anything actually, hence the reason she was described as incapacitated.
