Without seeing the video I was say that is no way to be true. Maybe without something foreign in the door. But it’s not like you couldn’t be a door stop.
For all we know the victim was waiting on someone and left the door open intentionally.
quote:
During a press conference, Lee Merritt, one of the attorneys for the family, said two independent witnesses alleged they heard knocking on the door in the hallway before the shooting. One of the witnesses said right before the gunshots she heard a a woman’s voice saying, “Let me in, let me in.” This directly contradicts Guyger who at first claimed the door was locked, then said the door was unlocked, and then claimed the door was ajar.
Most disturbingly, after the gunshots, one of the witnesses said she heard a man’s voice saying, “Oh my God, why did you do that?” Merritt believes that sentence was Jean’s final words.

I'm no legal expert, but I would think the absolute best case scenario assuming this all was just a tragic accident is still grounds for negligent homicide.

If a kick down your door and shoot you while you're drinking a beer watching football, should I get a lighter sentence since you may have been drunk?

If her tox screen is clean, I don’t even know how you charge her with negligent or involuntary homicide. At that point, it’s just a confluence of shitty luck for all involved with no one doing anything wrong. I go back to the door though, if that exterior door is closed and she can’t get in he probably comes to the door hearing her working the card, talks to her through the door, they figure it out and have a laugh over the situation. If her tox is dirty it’s a new ballgame. If not, just a tragic misunderstanding that can be handled in civil court.
I just dont see a way where if you or I do this that we also are not in handcuffs.

And believe her inability to know where she was resulted in a man's death in his home. Something wrong happened, even due to an accident.
And that is if that scenario is exactly what happened.

Not necessarily, but you should get a heavier sentence if his team was in the middle of a last minute comeback drive to upset the favored team, not a lawyer, just sayin

Did she think her fricking roommate changed the locks?

I dont know, but to me that indicates the door wasnt left open accidently if shes asking to be let in.

If the victim was sitting on his couch he is likely alive today.
Everyone is assuming the victim was just standing there when he was shot. We don’t know what exactly went down.
I’m saying if he was high and saw a cop walk in his door, it could be argued he would be more likely to act irrationally which would cause her to fear for her life.
If she walked in, saw a dark object, and shot. Then I agree it doesn’t matter at all what the victim had in his system.

I was under the impression that she lived alone.
Also, the casings and the victim’s location will tell the story of where they were in space and will tell a lot.
No way in hell she would have been able to stage the scene to match her story.

Just a small reminder, you're referring to someone entering someone elses apartment, then fearing for their life when they see the occupant.
I honestly hope you're never robbed, the bad guy could quote you there.

He was in his own house, someone broke in, and pointed a gun at him. How the frick is he supposed to act "rationally"?
She is the intruder. Her fearing for her life doesn't mean jack shite.

Yup, her role as a law officer should not give her a lighter sentence. She made a dumbass move and a man is dead because of it. She is responsible for knowing where she was and is responsible for pulling the trigger.

I can't believe folks are arguing against this notion.

As far as the marijuana goes, as a juror I would wonder if LE planted it when searching the apartment. Make the victim look bad and ithe killer look good. Amber Guyger was dead wrong with her actions that night!!!

The mJ should not matter at all, and it presence being broadcast reeks of a smear campaign against the victim who was shot and killed in his own home.

Add in loud music and you're good for a $4 civil settlement.
