They’re people who can drive flawless at .2 or higher. Does it make it safe? One lapse of judgement with that driver and a family is dead.

I’m not saying you in particular. But it’s sad when people say they drive after 3 beers in 1 hour. People don’t care about others.

I agree. Most of the time, they do not. It’s sad because the acceptance of drinking and driving. The push of .08, has made everyone think it’s okay to drive at .079. When in reality there isn’t much of a difference between .05 to .08.

It’s everyones fault. The judical system, the public and even law enforcement. Cops often let people go at .05 who shouldn’t even be walking down the street.

All else being equal, I'd pick the sober driver of course.

Just saying that all else is not necessarily equal. If the choice was between a slightly drunk professional chauffeur and someone who can't stop taking selfies on the road, I'd wish I had better choices but would probably go with the drunk. Or better yet, open my Uber app.

Well each state has an age of consent. So if the age of consent is 18 in that state, it’s the adults fault. Sorry chymos don’t get a pass regardless of gender with me.

Granted female suspects get way more leniency.

Exactly. People are shiet drivers. But with cabs and Uber, etc. There is no reason for anyone to consume a drop and drive.

§98. Operating a vehicle while intoxicated

(a) The operator is under the influence of alcoholic beverages.

(b) The operator's blood alcohol concentration is 0.08 percent or more by weight based on grams of alcohol per one hundred cubic centimeters of blood.

(c) The operator is under the influence of any controlled dangerous substance listed in Schedule I, II, III, IV, or V as set forth in R.S. 40:964.


The state would have to prove you were under the influence, though, which is very subjective.

I dont have a problem with him being charged with negligent or vehicular homicide, as I have said repeatedly in this thread.

On a side note, the babysitter of the 4 year old’s family has started a GoFundMe to help assist the family financially in the wake of the child’s death. I’m not the biggest GoFundMe fan but this is a legit one, especially having seen the financial costs you don’t expect in the wake of losing someone so young and in this kind of situation.

Vehicular homicide. Alcohol just has to be a factor in causing the accident.

Bunch of dummies on this board think they're OK to drink and drive just as long as they don't reach .08. Get in a wreck, kill someone or seriously injure someone, they'll find out that DWI's aren't the only bad thing that can happen to you in criminal court for drinking before driving.

Not necessarily true. It's the cops judgement below .08. If he decides you to be impaired, he can arrest you at .05 BAC.

And for me - plus also high school. And that was back in the day when the legal drinking age was 18. Doesn't matter.

I am grateful I survived. And that I didn't ever hurt anyone, or get hurt when I or one of my buddies was driving under the influence.

In the real world, people are held accountable for their actions. Especially when those actions cause another person serious injury or death.

Plus, can you imagine being that kid driver who has to spend the rest of his life dealing with the reality that he killed somebody's precious 4 year old?

Drinking and driving. It is really stupid to put yourself and others at risk. It isn't wrong and dumb only if you get caught. But most of the hot shots here won't realize that for years.

Minor as far as alcohol impairment goes but I’m sure he’ll be tried as an adult.
