That sucks because he wasn’t drunk. The alcohol content isn’t high enough to have caused the wreck. Terrible situation I feel bad for all involved and because it killed a kid he will likely get a hefty sentence and ruin his life too.

I'm pretty sure in Louisiana if someone dies in a wreck and the driver has ANY alcohol in their system, driver gets charged with something.

Mainly because I believe if he can be tried in an adult court, he should be judged by adult (21+) laws. Also because I am a firm believer that there should be one class of adults, not two.

Hypothetically, you are at a social gathering, and your child needs a ride home, there are two people available, one driver has not had a drink, the other has a blood alcohol level of .05 just like this kid, which one gets to drive your kid? Be honest, you know the answer.

go look at the federal government
fairly certain back in the day when drinking laws were set by the states... the feds came in and told each state "make he legal drinking age 21 in your state or lose federal highway funds"... and states whose drinking age was <21 changed the law almost immediately

Regardless if he was drinking, he drove off the street onto a sidewalk, into two people and killed a 4 year old. He should absolutely spend some time in jail.

It minimizes texting while driving b/c the kid had two beers. Basically says he did it because of the two beers, not because he was distracted. That little amount of alcohol is insignificant.
Idk the circumstances of the wreck or why the DA charged him with that. It could be that the DA didn't want to charge him with negligent homicide, because 1st DWI is a much lighter charge.
Eta: Law enforcement throughout the country couldn't give two shits about distracted driving. They've been told, trained, and get awards, promotions, and money for giving DWIs. That is what they care about

He hasn’t went before the judge or county attorney yet. The investigation is still open and the police can still add to his charges.
