UK Greek Pledge Kills 4 year-old in DUI Crash After Murray State Game. BAC: .051

In a campus-wide email, the President of UK stated:

1) The UK Police Department has opened an investigation and is working closely with Lexington Police. In preparation for this Saturday night’s game, UK police will install additional lighting along heavily traveled roads around the stadium.
2) The student involved in the accident has been suspended from the University, pending the outcome of investigations by Lexington and UK Police and our Office of Student Conduct.
3) The fraternity where the student has been a pledge – Alpha Tau Omega (ATO) – has been suspended on an interim basis, pending these same investigations. An interim suspension means all fraternity activities must immediately cease. Members may remain in their house during this time. A University employee has moved in to serve as a resident director. Administrative staff with the Dean of Students Office are working with the organization’s national chapter -- which also is conducting an investigation -- to ensure appropriate actions are taken.

Doesn't LA have some crazy low DUI threshold, like 0.02, for minors? Maybe KY has some similar law. But as far as level of impairment goes, 0.051 ain't shite.

This is a legit case where him being a legal adult should give him the same legal standard as other adults (i.e. BAC of .08 to be legally drunk).
Why do some adults get some legal rights that others don't?
All that said its tragic what happened, I just disagree with the DWI ruling.
To further this point, he will now be facing the full adult judicial system while being guided by standards meant for minors.

For a freshman in college who might not have much experience with alcohol it could be. I'd wager that if this kid had a 0.0 level that 4 year old is alive today

I legitimately shudder at the absolutely stupid shite I did in College. Especially getting staggering drunk and driving from Tiger Land to campus. That was many, many years ago and I still get mad at myself.

Maybe, but theres other factors here. Was the arrested driver at fault for the actual accident? Was the infant buckled in properly? Or is he being blamed simply because he got in a fatal wreck.
I only say this because .05 is not blacked out drunk. In fact if he had been 3 years older I doubt this makes the national news.

.05 is two beers in an hour or hour and a half. In my younger days, I regularly drank 3 beers in an hour, and was under .08 as per the breathalyzer in my truck that got calibrated once a month
