And in this case, an element of the crime is being a minor. It doesn't make sense for the government to have him be both a minor and an adult depending on what suits them.

So for this adult. Regardless if 21 or not. You can and should be charged at any BAC if you show impairment.

For the Kentucky statute. You are considered a minor to have possession or consume alcohol. If you are under 18 you go to juvenile court and 18 will attend adult court.
For example, you are a sophomore in college, likely 19-20. You get caught drinking, you receive an MIP (Minor in possession). The name of the charge varies by each state.

Driving after drinking alcohol is okay to a lot of people. It takes something bad to happen, before they change their tune.

Being under 21 is an element of the crime, not being a minor. The Govt isn't treating him as a minor, they're treating him as an adult who is under the legal drinking age

Several of you misunderstand something.
0.08 is the level at which an adult is assumed to be drunk. If you blow above that, the officer's judgement doesn't come into play during trial so it's often a slam dunk case.
But (depending on the jurisdiction) if the officer thinks you're under the influence you can get charged even if you blow less than that.
Cops often don't arrest someone who blows under 0.08 because it's more of a judgement call and not as easy to prove in court. But they can and will if they think you aren't able to drive safely.

From what I’ve read and heard, he was pretty clearly impaired when they picked him up. It’s possible he wasn’t just impaired by alcohol. Especially since he’s rolling with the “only had two beers at 9:30 am” story. Of course it’s also possible he was texting and driving too.
Either way, I feel like you have to go out of your way to drive with any kind of significant BAC these days with Uber, Lyft, etc. And if he wasn’t impaired, pay attention when you’re driving in an area that’s busy as frick.
Unfortunately for him and his family, that one moment killed a child and ruined his own life. It’s just not worth it.

.05 isn’t going to determine the safety of my child. .08 is the legal limit for a reason.

He was .05 after everything and going to hospital. He refused at the scene. So during the actual wreck, he was higher than .05.
If it took an hour to get blood at hospital, he was over .08 at the wreck time.

Not drinking per se, more of the criminal liability associated with legal driving after drinking.
21 year old adults dont have to worry abt getting a DWI with a BAC of .051.
