U-Haul publicly announces hiring discrimination against nicotine users

starting February 1st, U-Haul will not hire people that use nicotine in 21 states. This just seems primed for a nice lawsuit. I don't see how a company can ban the use of a federally legal product. That seems like textbook discrimination. I would love to see the fall out of a company saying that an employee could not drink coffee on their free time.

Smokers aren't a protected class. If I owned a company I wouldn't hire them either.

I’m the name of keeping their equipment clean and safe health wise I can see this Is that enough to avoid lawsuits?

drinking soft drinks obsessively increases blood sugar which increases insurance premiums

Yep. Can you imagine the outrage if you setup a corporate policy that you would only hire people with a sub 25 BMI?

With employment at a record high - and trying to fill less-than-desirable roles - it’s a great idea to put policies in place which cut your pool of candidates in half.

We quit hiring smokers a couple of years ago. Their sense of entitlement is off the charts. They feel like they deserve extra breaks for their habit. It pisses off the other employees not to mention how nasty they are.

When I worked in the office I never could comprehend how these people get a 10 minute break every hour to go smoke.

Plus they are usually fat and eat like shite too.

Discrimination is not illegal. Discrimination on the basis of sex, race, and religion is illegal. But general discrimination is not even frowned up, businesses use it daily for all sorts of decisions

Bad habits are not a protected class

You can discriminate on any basis other than certain protected classes (race, gender, religion, age, nationality, etc).

Smoking, being fat, being ugly, being tattooed is not a protected class.

It’s why employers can change smokers more for health insurance.
