Tragic series of events in LP leaving 2 BR children dead...

What a tragic series of events. I didn't realize you could be charged with Vehicular Homicide by leaving obstacles laying in the road that led to a death, even though that guy was a dumbfrick for not removing the debris and deserves to get arrested for something. I just didn't know it would be Vehicular Homicide and Felony Hit and Run. Never really thought about it actually. Poor children and mother.

Yeah, I wondered the same thing. Seems like a weird chargee for that.

Seems like negligent homicide fits more here.

Regardless, partially his fault that those kids are dead.

My guess is those charges were knee-jerk reactions after officers got a firsthand look of the aftermath

Why do you have to make such a hazzard sign production getting this compacter off the road? Just lift and tumble the thing to the shoulder. 30 second job, or is this some 4 lane with tons of traffic?

What an awful story. Appears Michelle Ramsey, the driver of one of the vehicles on the side of the road, hit the compactor in the middle of the road. That started the chain of events where the Butler woman pulled over as well. Damn that is just terrible.

In Louisiana, that charge RS 14:32.1 is only available when the operator is impaired in some way, so this is bad reporting or mischarging by the authorities.

Maybe "negligent homicide" RS 14:32 - is available.

Lay people make this mistake all the time, though, confusing 1 for the other.

ETA: I'm seeing the reporting develop if he was proven to be impaired, it's possible vehicular homicide is available under that fact pattern.

It was two women who were pulled over, one of which had already hit the compactor.

It wasn't some elaborate operation.

Failure to Secure Load seems logical but can you prove that he knew it fell out of his truck? If he didn't know then how could he do anything about it? He was impaired so he is going to have a really hard time defending himself, either way. That is such horrible luck for the families involved and it sounds like one of the vehicles was just there helping.
