If the guy who dropped the trash compactor was at his house when the cops found him, how can they say he was impaired at the time he originally pulled out of the driveway?
correct.
"Judge. I didn't even know it was in the bed of my truck. Someone must have put it there and i didn't even know it had fallen out. I went to the store to get me a 12 pack of Buds, came home and started drinking."

Case dismissed.

But then caution was put out for the situation to alert everyone else.

without the first crash there wouldn't have been 2 vehicles on the side of the road with children standing outside of them. I am not saying it isn't a stretch but he caused the whole series of events.

This is a slippery slope that I don't think you should go down.

For the person downvoting, would you also support charging the parents that put their children in position to be killed that day?

How in the hell do you not see traffic triangles approaching on that long of a straight away?

In my experience, most people don't give a damn about people broken down on the side of the road, or walking down the road, or pulled over on the side of the road. They buzz by them to frick with 'em. How dare they inconvenience them. LOL poors (edit: that's what they are thinking, not me).

Bottom line if you don't secure, you're responsible, whether you know it or not. Same with a hit and run. Imagine hitting someone and just keep going. "Oh, I hit someone? I didn't know that I did, so I'm good? K, thanks. See you later "

This happened not that long ago with a LP man. He hit a guy stopped in the middle of the road very early one morning and he claims he thought it was a deer. They traced it back to him a couple of days later. Not sure whatever came of it.

I am not saying he should or shouldn't be charged just why he probably was charged.

He wasn't charged. He was arrested and booked. He will not be charged with much past an unsafe load if he has a lawyer with an IQ above 60. 1st guy was a grade-A a-hole but driver 2 killed the people.

With your line then we can go after the maker of the compactor bc had it not failed then driver 1 wouldn't have been hauling it off.

now that is a stretch. Bottom line is first guy caused all the shite. He doesn't deserve the jail time the guy who killed the kids does but he deserves some IMO

Come on man, you're getting a bit ridiculous.

I'm genuinely surprised this many people are coming to this guy's defense. If he ends up with a lesser crime, so be it, but if there was ever a time to book him on the highest possible offenses, this was it.

What can or cannot be proven is another story altogether.

I can assure you the time frame of events here does not allow for the "I didn't know it fell out, went home, started drinking" defense. Much more bang-bang sequence here. Tragic for all involved.

Don't care to share more details than that, but the first drivers negligence clearly started this. And I feel certain that witness reports will confirm this.
