I agree it will be hard to prove he knew beyond a responsible doubt unless he gave a statement or witnesses saw him pause. But failure to secure is self evident as would be impaired driving and negligence of some kind. Particularly in the death of two small children. For instance:

On a related note, this is one of the bigger concerns with texting and driving IMO. Between adaptive cruise control, lane safety features in the vehicle and on the road, and basic peripheral vision, it is difficult to run into a vehicle or run off the road. However, an object in the road is an entirely different story.
I've looked down to grab something and looked up to see a ladder laying parallel to my lane right in front of me. I swerved in enough time to miss it and someone was pulled over on the other side of the 4-lane going to pick it up, but it could have been a disaster. Texting makes those kind of things all the more likely.

And to think people got pissed at me for stopping in the middle of Barringer-Foreman with my hazards on to clear a 10gal Shopvac that some other dumbass dropped in the road and left there.

As do I. What a terrible tragedy.
This is why you should not assume you're safe on the shoulder. In no way would I blame the victims in this tragedy, but standing on the side of the road does not ensure your safety. I've seen too many accidents happen someone is pulled over to the side to believe that fallacy. Whenever possible you should remain in your vehicle and pull way off the road.

Drunk #1 (Rose in the 1997 pickup truck) - just dumps shite in the road for other people to deal with.
Accident because of Drunk #1 - reasonable people are likely hurt, certainly shaken up and forced to deal with the consequence of Drunk #1 - inconvenienced, damaged, interrupted certainly, as well as placed in harm's way. Drunk #2 (Ervin in the 4Runner) comes along and finishes off a terrible, tragic parody of Death Race 2000.
I say cage fight for charity - to the death for one of them and a long, long prison term for the survivor.

My bro in law and his mother were jumping off his truck on the shoulder of the road. A drunk ran off the road and they were smashed between the trucks. She lost her legs and he was crippled. Don't stay in your car or stand anywhere around it if you don't have to. Get completely away from it.

Ervin will be and should be the only one charged with any homicide. Rose should have done the right thing but there's no way you tie that to him after the time had passed and caution markers were put out for his said "screw up".

Wrong, they are both at fault. Accident would have never happened if the first mouthbreather would have cleared his shite from the road (shite just roll it into the ditch like the rest of the Livingstonites). mouthbreather #2 was driving impaired and ran over several children killing 2 of them.

IDK man, if his drunk arse doesn't fail to secure the compactor and lose it in the middle of the road then no one is dead.

If the first vehicle had wrecked and caused all the damage then it would be on Rose's head
But that vehicle stopped and placed caution to the screw up that Rose caused. Just as if he did it himself. It's a lot worse that Rose didn't stop and he will be charged with so.e lesser included offenses but I'd give a very slim chance that he is charged with homicide of any kind.

If the guy who dropped the trash compactor was at his house when the cops found him, how can they say he was impaired at the time he originally pulled out of the driveway?
