I am curious to see how the local districts would handle so many more jury trials. If I remember correctly district courts are funded almost entirely by the parish and not the state.

You want to know why your premiums are high? Because judges are awarding $50k to every piece of shite who claim their back hurts after a car wreck, and because lawyers like Gordon, Dudley Debosier, Gauter Amedee, act like clowns in the court room and make the insurance companies out to be the bad guys. Which is another thing this bill does, is prevent the trial attorneys from mentioning the insurance companies as defendents so they don't drum up sympathy from the jurors when the assclown trial lawyers say "state farm has plenty of money". Guess what, that money, is YOUR MONEY. So for every lawsuit they have to pay out, YOUR RATES GO UP.

If getting rid of direct action and collateral source are the only things that come from this, it would have a huge impact.

They are. And ask Golfer who pays the costs of furnishing juries in the states with lower (or no) thresholds.

There is a reason the judges and clerks of court all came out against the bill. They know what it will do to the judicial system.

So farmers, trucking companies, loggers, etc don't pay auto insurance, right?

It’s not tort reform. It’s lowering insurance premiums.

Oh please. This doesn’t change anything for those actually needing to sue following a motor vehicle accident.

I'm a defense attorney and the ONLY people this legislation will do is increase the bottom line for insurance companies. And your rates will not go down. Trust me. You're living in la la land if you think the insurance companies are going to lower rates. They will find something else about Louisiana to "justify" keeping the rates where they are or raising them.

How many of the frivolous fraudulent injury cases would go to trial in your opinion?

You think jury trials in Orleans Parish will go well for insurance defense?

Where did I say that?

I also pay for auto insurance. Why is that germane to anything you’ve said in this thread?

So lets keep the status quo? Competition is what will lower the rate. More profitability means more companies will want to enter the market. A large company like Nationwide might actually enter Louisiana. Instead we're the only southern state they are not in. Wonder why that is?

The insurers will always maintain a profit margin but they’ll also compete with each other thereby driving prices down. Maybe not drastically.

Why are Louisiana rates so high? Is it just bad roads, bad drivers, and/or uninsured drivers? Bc I bet other states with lower rates, esp the ones with high numbers of illegal aliens, have many many uninsured drivers.

Why does everyone keep saying this, but the data doesn't support this?

There are states with nearly identical demographics as it relates to number of uninsured, liability minimums, accidents per insured, etc. Yet they have premium amounts 1/2 that of LA. Why is the only difference the rules being discussed in this HB?

The sad fact is that the level of discussion in this thread is right on par with what is going on at the Legislature.

“It will lower rates!”

“No it won’t”

“My buddy’s wife said it will”

“Pics?”

The PI atty's don't want to give up their gravy train - this bill might make them have to do some work.

Defense attorneys benefit from the current climate, so STFU.

That's a good thing, numbnuts. Heathy insurance carriers mean more options and competition. Look at the current workers comp climate- there are over 350 carriers writing business in Louisiana at the moment and the business owners are getting incredibly cheap rates.

Ok sure, I trust you Mr Attorney.

Let me give you a real world example of how this has played out in other states:

Florida Insurance Companies: This tort reform bill will lower health insurance premiums and the cost of healthcare by reducing lawsuits and payouts !!

Florida legislators: Sounds great...let’s do it!

10 years later...

Florida Supreme Court: There is no evidence to suggest whatsoever that the law resulted in a reduction in insurance premiums or healthcare costs. In fact, they’ve gone up. So, we strike down the law.

You guys are being sold a bill of goods and are celebrating the insurance companies who are doing it to you. Have fun in jury duty!
