Yes. Trial lawyers love to do this. It drums up sympathy that it's the evil insurance companies that won't give this poor hurt person their money. They say, that xx insurance company has all of this money while poor old Wanda doesn't have a pot to piss in. The jurors, then sympathize and say, "you know, maybe she should get something", then bitch about their insurance rates going up for "no reason". It's going up, because of your decision to award the plaintiff an outrageous sum. Most jurors, however, doesn't understand the correlation between lawsuits and insurance premiums, and just think it's rich company should pay out.

LABI is not painting it as tort reform. They’re painting it as a pro-consumer measure to reduce rates.

This is correct. Which when it gets confirmed in the Senate, which it should, would make it hard for JBE to veto, during an election year. But, he is bought and paid for by the billboard lawyers. So who knows.

It hasn't gained traction on Poli because we've seen this dance before. If it were true tort reform it would never make it out of committee. if it makes it out of committee it's so watered down as to be useless.

Do you think the insurance companies are going to say it's going to lower premiums (i.e. profit)?? Of course not. They are in favor of it because it necessarily will lower liability payments. That's literally the only reason the insurance industry would ever support legislation. So, they are taking the "getting my cake and eat it, too" position.

Yes, they are in favor of the bill (lowers liability payments) but are saying it won't reduce premiums (keeps profit high). Think about this stuff. Don't just look at the words they say.

I'm not painting them as anything. LABI literally stands for Louisiana Association of Business and Industry so make of that what you will.

I'm just trying to keep the messaging on point. This is not about the bottom lines of business and industry. It's about reducing rates for the consumer.
