Not sure what this has to do with the attorney. Presumably, the guy called the attorney on his own, saying he was injured. Attorney agreed to represent the person claiming to be injured.
Pretty sure society would start screeching if attorneys refused to represent anyone they thought was an idiot.

Seriously though, the possibility of this failure is foreseeable and can be prevented by a simple, redundant safety system.
