The legality was debatable. Thankfully the grand jury didn't indict. Turned out later the little shite had already committed a home invasion and had a warrant out for his arrest. Not that Merritt could've known that, but it makes it even better that he got shot.

If I recall he was on his front porch. The punk jumped a fence to get into the yard and it was middle of the night

No, he went out on to his driveway from towards the front of the house, so he ended up between the street and the kid. The kid had jumped a 4' or 5' gate at the end of the "driveway", which was really more of a parking area/alcove along the side of the house. The house was kind of shaped like an upside down "L", with the parking/patio/yard on the right.
Anyway, he ended up shooting the kid (he was 15, but looked about 30) in the head from about 30' away (I don't remember the exact distance, and there was some debate at to how far away he actually was. Landry's defense saying closer, cops saying further. The distance publicized was from where the kid was laying and where the ejected casing was found.)

Yeah, you're right.
They did find the little rat's fingerprints on his shutters, which had been opened.
Here's why I thought he was inside:
A source in the District Attorney's office who was involved in the case, however, provided some insight. Prosecutors considered a variety of possible charges, but ultimately decided there wasn't enough evidence to prove Landry acted criminally. State law, the source noted, says "there shall be a presumption that a person lawfully inside a dwelling, place or business or motor vehicle held a reasonable belief that the use of force or violence was necessary to prevent unlawful entry thereto or to compel an unlawful intruder to leave the premises."

Fair, I agree with you.. But should it be??
It's honestly bullshite that in the land of the 'free', in most cases criminals have more rights and protection than their victims...
People should have a right to protect themselves and also their property no matter what.. I can't stand the fact that it's so easy for people to successfully take what others work hard and pay for and get away with it or suffer little or no punishment
ETA: yes, I was a victim of a robbery nine years ago (they took EVERYTHING) and I still feel bitter and violated... But knowing what I know now, if I catch someone coming into my house or vehicle with the intention to steal or harm, I'm going to stop them dead in their tracks
