That is what they were arguing on the news but I think they might actually have a good case against the school district. The only way it is a workers comp claim is if they can prove being shot by a first grader is part of the risk when accepting the job. I have a hard time seeing a judge agreeing with this. They compared it to working at 711 where you know the store getting robbed is a possibility and therefore couldn't sue if something like this happened.

She was injured in the course and scope of her job therefore she is entitled to WC benefits. It doesn't matter whether the incident was anticipated.

Wow . Where are the parents? This kid needs his arse whipped and some mood stabilizers as well

How is getting shot on a gun free campus in the scope of her job?

If someone bombs an office building, are the workers only entitled to workers comp?

All I am telling you is what was reported. I am assuming the lawyers know what they are doing.

The teacher was in the course and scope of her job and is limited to WC against the employer. She may file a tort suit against an outside party .

Yes relative to her employer.

Plaintiffs don't win every case. Doesn't stop lawyers from filing lawsuits and trying to create new law.

It s mind-boggling to me that so many teachers and administrators knew this kid had a gun on him and nobody took it away from him. That's egregious IMO. It's not like he had some contraband shite that he shouldn't have and should get in trouble for...he was a violent kid with a frickING GUN on his person.

All this "reporting the gun to so and so" bullshite is just nonsense. Take the gun from him and prevent a shooting. And I don't even mean in a Billy Badass kind of way. shite, gang tackle him if you need to and disarm him. But don't let ANY kid there have a gun, especially one that is disproportionately violent with a history of violent attacks.

Also, that kid has been failed by his parents and his society/surroundings. And I would bet money he has also been sexually abused as well based on the other things mentioned in the article. His life is already ruined/doomed, at six years old. That's so fricking sad honestly.

Imagine being an adult who sees a 6 yo with a gun at a school and not taking it from them because the assistant principal told you not to.

They should all be fired at minimum and the principal should be in jail.

Freaking jokes, all of them.

Man, if she did I bet the father would be working three jobs to pay those damages! He'd hardly be able to see his kid!

Her medical bills must be pretty high and she may have a form of PTSD.
She will have a difficult time teaching again thus she is denied the use of her career choice.

Medical costs are paid by workers compensation for the employer. This would include counseling for PTSD issues.

If she is unable to return to her employment whatever benefits she receives is governed by the state laws.

No this isn’t “hood rat” this is severe behavioral problems, and he frankly needs to be in an institution and probably medicated.

She should get every dime of it. The kid's parents should have to pay too.

I had to keep checking that all issues and descriptions mentioned in article were about a 6 year old.

Also this is ignorant. We aren’t talking ADHD, dyslexia, or some happy kid with Down syndrome. Even having parent in room could be disruptive to other kids especially if still violent at home. In this case if parent can’t be in class than he needs to be in special Ed room or not in school that day.
quote:

were aware that the child was violent at home and his parents refused to place him in special education classrooms.

Goal should be as much regular classroom time as possible, but for some kids that has to be very limited at first.

How did 6 year old get a gun? Besides age it seems like this kid can’t be mentioned by anyone without the word “violent” included.

This child most likely exists solely due to the welfare benefits that are attached. Father's whereabouts (or even identity) probably unknown. That city is an absolute shithole.

The answer above also applies to this question.
