Settle for $10MM

$4MM goes to taxes which goes back to the district

$3MM goes to the lawyers (of which $1MM goes to taxes and back to the district)

She walks away with $3MM and the kid.....well.....

nah, This isn't evil, this is just a kid thinking that living the hood rat life is cool.
6 year olds don't learn the things he's learned without people around him teaching him this and enabling it.


That kid is doomed to a life in prison more than likely, if he even makes it that far without being murdered.
He will never be a productive member of society.

I honestly don't know what the solution is for that kid.
I think he needs to be removed from his "family", but to go where, i don't know.

I’ve said all along this is what teachers need to start doing when they deal with kids who are absolutely out of control.

I guarantee in her contract there is a clause regarding the school providing a safe learning environment. Many are not with lack of discipline.

They should sue the district and start filing charges against these kids. And if that doesn’t do it, start holding these parents accountable criminally as well.

Good! I hope she wins. As a teacher, we get crapped on by many...even on this platform, but the amount of garbage we deal with and are NOT ALLOWED to address is a real force that keeps our ability limited to handling certain disciplines. Since NCLB, we refuse to remove the problems. Furthermore, the imaginary position of Equity Directors has forced us to discipline certain races of people more or less tough than other races. It's a race to the bottom!

She is lucky that she did not die.
Her medical bills must be pretty high and she may have a form of PTSD.
She will have a difficult time teaching again thus she is denied the use of her career choice.

What is really important here is that if she wins this could change the world of public education. No longer will administrators will be able to get away with sweeping problems under the rug hoping that they will magically go away.
I know a retired elementary public school principal here in Beirut Rouge that bragged to me that she flushed drugs that she found on the kids down the toilet daily. I told here that she was flushing evidence away. She told me that the school brd wanted this and BRpd did not want to deal with it.
Our public school system and justice system is broken.

For gross negligence? I don’t think you are correct. It is a state by state issue, but most states carve out an exception to the exclusive remedy for gross negligence.

Saw on the news that the schools defense is that this a presumed danger when you accept the job. Meaning they are saying it is apart of the job to be shot by 1st grader.

I’d be surprised if that holds up. They’re almost certainly going to have printed language in a student handbook that says their discipline of students is based upon a safe learning environment. And that’s if the teacher doesn’t have that language in her personnel contract (it almost always does and is often used to terminate folks caught not supervising kids).

That is what they were arguing on the news but I think they might actually have a good case against the school district. The only way it is a workers comp claim is if they can prove being shot by a first grader is part of the risk when accepting the job. I have a hard time seeing a judge agreeing with this. They compared it to working at 711 where you know the store getting robbed is a possibility and therefore couldn't sue if something like this happened.

This is like a 711 being robbed by knifepoint and the owner not calling the police and telling the robber it’s cool; he can still hang around. Then the robber shows up with a gun, and it’s reported to the owner. Owner says not to worry about it. He’ll leave eventually. Then the robber shoots the cashier.

Would the cashier be able to sue then?
