Fine then, I'm sure there is also a catch all for use of four letter words. Teacher sends frick in a message to a friend. Kid breaks into teachers phone and tweets that out. Is the teacher still terminated?

You may not agree with it entirely, but I assume that a "fine then" is something like a "fair enough" or "fair point", so apply that to the gun example.

This is actually a several parter:

1. If you bring a gun into a "Gun Free Zone" you are knowingly violating the law.

2. Someone breaking into my car and stealing the gun is still breaking into my car and stealing the gun. Both illegal.

3. I will probably be issued a ticket or arrested whatever the statute demands for a gun in the "Gun Free Zone".

4. Does not negate the crimes committed by the other person.

FYI: When you give the scenarios, even though you may not realize it or specifially state it, you are implying that the teacher did something illegal. That's why people keep stating the teacher did nothing illegal.

More like when my niece is being a 3 year old and I cannot get her to listen so I stop trying and decide to focus my efforts elsewhere.

Thats my exact premise for the teacher, fwiw. Both are responsible for their roles imo

Your analogy is not analogous. That's the problem. In the gun case, there is responsiblity, in the teacher case there isn't.

The teacher did nothing wrong. Her privacy was violated, then some laws about sending objectionable material were broken by the thief.

You can access porn from a phone so nobody should have phones in school? Computers?

The fault lies with the little bastard who has not yet learned to keep his mitts off of other people's property. There is a reason they call it" Her phone".

He should be charged.

These things aren't mutually exclusive. To say the kid is guilty of wrongdoing does not suddenly make it okay to have it in the first place. No one is defending the kid to say they did nothing wrong. But, if it is that easy to access, it's probably improper for the teacher to have at the school. If the teacher had a home made sex tape. It's just a blank DVD in her purse. Nothing to say this is porn. Kid takes it and watches it. That's more theft than looking into a phone. Would you say it was okay for the teacher to have that DVD are school in the first place. It's private property. You have to steal it to look at it.
