I'm pretty sure it's not illegal for me to have porn on my phone as long as the party is of legal age and consented. Have MY image on MY phone is not illegal.

If I leave my house unlocked, that does not imply that someone, anyone, can come inside and take my things for their own personal use
quote:Anyone in this thread say otherwise?
While it's prudent to lock a door (or a phone) not doing so does not mean that I'm giving consent for others to take my property.

As it has been pointed out, this is all you need to know.
Correct. Shouldn't go any further than this

yea it's a huge freaking difference than if nothing is protected and he could very easily access content not allowed at school.
Nope no different at all. He still took property that belonged to someone else without their permission.

degrees of wrong are irrelevant?!
You just said that if the kid HACKED into the phone, it would be a big deal.
So you're saying having nudes on a phone that's password protected, it's ok. If it's unprotected, it's wrong.
You know what that's called? Different degrees of wrong.

now we got qualifiers to theft?! and mischief and malice? stolen isn't good enuf? wtf?!

Degrees of wrong is irrelevant, the only question is whether it is wrong/against the rules.
Should you or should you not get in trouble for having the gun in the gun free zone?
It is as relevant as how easy it is for one to access another person's private property. Which you said is very so which is it? You can't have it both ways.

quote:When did I say otherwise?
It doesn't matter how easy it is to access it. If you knowingly take someone else's property without their permission, you have stolen that person's property
quote:I don't know what this means.
I think I've read anything that said, "it's not really theft if it's easy to take. Next time make your stuff difficult to take and we'll call it theft."

I'd love to see the list of policies you'd have to create to literally cover every single possible incident to appease.
Like possessiong porn for a teach at a school with minors is all hunky dory, no big deal. Sure thing.
Ok, so which policy did she kinda sorta violate?

You have you fricking tard. Implying that as long as it's easy to access it's not the kid's fault is pretty much saying it's not the kid's fault.

She didn't have porn. She had pictures of herself nude. It's not like the student sent out videos of her being spit roasted. A more fitting analogy is what if the student walked up to her and ripped her blouse open for the whole class to see. Is there a major difference having her nudity hidden on a phone v. by a blouse? And if the student displayed the nudity to other students via assault instead of theft?

But in general, yea if the kid had to hack into her phone bypassing security stops, yea it's a huge freaking difference than if nothing is protected and he could very easily access content

Did he have a tough time accessing it, yes or no?

We've been talking all along about whether the teacher should be fired or take some responsibility, now all of a sudden you're magically talking about the student, not sure why.
Posted on 3/1/16 at 4:11 pm to shel311
Once again, which policy did she violate?

Too funny.
Plus, I already addressed that specific question.

This is up to the school board...and this is not what you have been arguing.

take some responsibility
No. It is never your fault when someone else takes your property. That is all on the student.

The point is that you said it's only wrong as long as she doesn't take precautions to safeguard the pics.
