The media consistently portrays the story as a battle between ‘gig economy’ companies and exploited drivers. But a Rideshare Guy poll of 1000 drivers reveals that 71% wanted to remain independent contractors. Just 17% wanted to be employees.

This makes me so angry. the state thinks they are helping these people but they aren't, and now the jobs could be gone forever.

I fundamentally do not understand why so many activists think the gig economy needs to be reformed. Nobody is forced to choose the gig route. Like anything, it has pros and cons.

Why not let people choose on their own how they want to work?

Sorry for harping on this, but this is going to be such an inconvenience for so many people.

had a musician friend of mine also complain that the law banning gig work is affecting that community badly as well.

with how corrupt louisiana is, don't be surprised if some asshat out of br or nola tries to push through something like this.

Yeah some work just isn’t full time. Like bringing different musicians through a club. So each club has to treat them like full employees? What if I want to hire a band for a birthday party?

I guess they could form up and become a company and then I’d hire that company?

How ignorant am I sounding or is this spot on?

I don't know why, but I can't stand when people say "gig economy".

But yeah, California is over-reaching again while saying it is for people that don't want their help.

I expect Prop 22 to pass by a large margin in November, but I could be giving California voters too much credit

ETA: Prop 22 basically reverses the law classifying the drivers as employees

What's keeping "regular" companies from reclassifying all of its employees as "gig" or independent contractors? Think of the payroll taxes that could be saved

Yet they all voted for the Democrats in office that made the new law and will continue to vote Democrat even after this.

The IRS. There are federal guidelines that help to classify someone as an employee or as a contract worker. The fact that an Uber driver uses their own car and dictates their own schedule are huge in those guidelines.

ETA:

quote:

Consequences of Misclassifying an Employee
Classifying an employee as an independent contractor with no reasonable basis for doing so makes employers liable for employment taxes. Certain employers that can provide a reasonable basis for not treating a worker as an employee may have the opportunity to avoid paying employment taxes. See Publication 1976, Section 530, Employment Tax Relief Requirements for more information.

In addition, the Voluntary Classification Settlement Program (VCSP) offers certain eligible businesses the option to reclassify their workers as employees with partial relief from federal employment taxes.

The IRS can help employers determine the status of their workers by using Form SS-8, Determination of Worker Status for Purposes of Federal Employment Taxes and Income Tax Withholding. IRS Publication 15-A, Employer's Supplemental Tax Guide, is also an excellent resource.

Workers who believe an employer improperly classified them as independent contractors can use Form 8919 to figure and report the employee’s share of uncollected Social Security and Medicare taxes due on their compensation.

The IRS Small Business and Self-Employed Tax Center provides a multitude of resources for small businesses as well as self-employed independent contractors.

Pretty dumb rule. Then Uber is going to not allow its “employees” to drive for other ride shares.... which I am sure most of these people want and do driver for other ride share companies.

What are the benefits for the drivers as INdependent contractors? No limits to time they can work?

One thing I saw Is that Uber essentially uses this to get around certain taxes.

I imagine They don’t pay overtime either.

The benefit is they work as they please. They don’t have to drive for Uber if they don’t like the compensation.

That’s not going to change just because of their classification.

It could. They can require that you now schedule your time and only work those hours that you schedule. They can limit the number of drivers available for given times. They can schedule "newer" drivers to the shitty hours until they reach a certain number of hours or a certain star rating.

Lots of ways they can control that.

The frick it isn't. If you are costing me more money in benefits and taxes, then I will have you working when I say to work making me more money.

If an Uber driver gets into an accident with injury, who’s responsible?
