First, you really don't know why the child was not properly secured. Then, the mother wasn't even driving and is it 100% sure that the baby would have lived if some off duty cop was fricking around in his corvette going 94MPH?

but the fact that a baby died doesn't absolve the other occupants of their multiple violations.

Getting charged for not wearing your seatbelt as you get crushed in a car wreck seems so ridiculous to me

Being forced by law to wear a seatbelt is ridiculous in and off itself

I am sorry mike. You were wxtrmeely wrong when you said latch was mandated by law

You are simply wrong when saying latch is safer

Sort of like that speeding ticket on top of the negligent homicide.

Not going to disagree.

Can we please review all cases of child death by vehicular accident prior to child seat legislation and retroactively arrest the parents of these children?

It'll really clear up SSI funds.

This is absurd. This is why no one respects the law, law enforcement or our judicial system anymore.

Agreed. I think this is more about trying to get people to secure their kids in the car than to make their guy look less guilty. They probably don't mind that happening, but more towards, hey people buckle your damn kids correctly.

The negligent homicide charge will make a difference, but losing your child won't?

I find that line of thinking difficult to rationalize.

The process is what's jacked up here.

Send it to a grand jury and let them decide to indict or not.

I'm talking about the ones who ride around with 2 or 3 in no car seat at all. And yes it is difficult for you and I to rationalize, but not for others who live in a completely different world than you and I while physically located a few miles away.

Like to pile it on a little, I see. Do you feel better? How about trying to have a little tact, if compassion isn't your thing. The woman has lost her child. Unless you know how and why absolutely, and have lost a child too, I'd wait to call her a shitty mother. Think it all you want, but you really don't have to try to make her look or feel worse.

We may disagree with how we should apportion blame here -percentage wise. But there is no doubt who the victim is here. Which is why a jury would never convict her . This never gets to trial.

Bump with update from the Advocate. Mom was rightfully arrested.

quote:

Police spokesman Sgt. Don Coppola Jr. released new details about the crash Thursday in response to questions about where exactly the car seat was positioned. He said it was "on top of the center console, wedged between the front passenger seat and the driver's seat." Coppola said Stephens described the location of the car seat to investigators after the accident.
