State Rep. C. Denise Marcelle "seriously concerned" with arrest of mother whose baby died

"She already lost a child," Marcelle, D-Baton Rouge, said Wednesday. "I just think that unless I'm missing something, I'm seriously concerned about it."

Brittany Stephens was arrested Tuesday on negligent homicide after police found that in an Oct. 12 wreck her daughter's car seat was not secured and the straps were not adjusted correctly for the child's height, according to her arrest report. Police said the "lack of securing the seat to the vehicle and the loose straps are a contributing factor in the death" of the child and "show gross negligence" on the mother's part.

an investigation into the crash found Manuel's Corvette was traveling 94 mph when he struck the vehicle carrying the Stephens, three other adults and four children, including Stephen's daughter, Seyaira.

My question is would prosecution possibly prevent this from happening again? Would prosecution help to dissuade her or other mothers from repeating her mistake?

If so, then the decision is likely just. If not, Denise has a legitimate point.

Can you elaborate?

The mother was being a shitty mother and her child died because of that.

Eta - not that I see this arrest changing any future decisions of mothers who may not strap their children in. Just wondering what you think her point is.

Police and state troopers will check your car seat for you for free. If it is installed incorrectly, they will fix it for you. C'mon people.

That child could have been riding on the roof and made it home fine but for fact that that a-hole was doing 90+ on Airline Hwy.

Leave this poor woman alone.

Is the child dying punishment enough or should a criminal punishment be levied on top of that?

I’d also be interested to know if the child was in a car seat and perhaps not buckled perfectly.

My gut tells me LEO issued the arrest to protect their own and give his defense an opportunity to lessen his criminal and civil liability.

According to the article the carseat was not secured and the child was not properly strapped in either.
