I never thought I'd ever say this, but I agree with C Denise Marcelle.
Ugghhh...i feel like I need a shower now.

Does a 90+ mph impact protect a car seat from becoming dislodged from those connectors?
Posted on 2/28/18 at 1:09 pm to kingbob
This is ridiculous.
The male driver was at fault here. I'm sure the mother didn't intentionally have loose straps on the baby. She lost her child because the guy was going 94 MPH and driving like an a-hole.
I am pretty appalled she was arrested for this. It's not like the kid was in the front seat with no seat belt on.

Sounds like a question for an expert witness.
ETA: Also curious what sort of vehicle they were in, considering there were 8 passengers according to the article. Was someone just holding the car seat because there wasn't enough room?

Do public defenders have a budget for expert witnesses?

Yes, and he was already arrested. As he should have been.
If he was going 94 in a 55 and she did NOT have her baby's car seat latched/secured, he should get Vehicular and she get Negligent homicide respectively.
Not sure Louisiana has that law for just speeding though. It should

The officer, Christopher Manuel, 28, was driving north in a 2007 Chevrolet Corvette shortly after 8 p.m. Oct. 12 on Airline Highway when it struck a Nissan at the intersection at Florline Boulevard that was occupied by four adults and three children.

Brittany Stephens, 20, was arrested Tuesday on negligent homicide after police found that in an Oct. 12 wreck her daughter's car seat was not secured and the straps were not adjusted correctly for the child's height, according to her arrest report. Police said the "lack of securing the seat to the vehicle and the loose straps are a contributing factor in the death" of the child and "show gross negligence" on the mother's part.
I think the point is being missed here on why she was also charged. How many people can an xterra seat safely?

As a parent, I am pretty sure 99% of the time your child seat could fail the actual precise protocol considering your toddler is a tyrant and moves like crazy in that thing

If the mother and child were white, would she be "seriously concerned"?
Does anyone honestly believe they would have arrested a soccer mom for this? This will be an even bigger joke when the DA refuses the charges. I am betting the police didn't consult the DA prior to doing this.

And they had 8 people in it.

They might have some evidence that we are not privy to. But what pisses me off is this LSU law professor Ken Levy saying it might be about race.
Correct me if I am wrong but I believe the police chief would have the final say if someone should or should not be arrested. Oh and by the way he is black
quote:
Levy also brought up the question of whether the mother's race could have played a role in her arrest. "I do wonder if race matters here," he said. "I just wonder if the parents were white, if she would have been arrested."

Exactly.
The driver of the vette is at fault but the driver of the other vehicle is responsible for all passengers in their own vehicle which had too many people to have the child properly secured.

There are X-Terra’s with third row seating. And three seats in the last row.
