This is ridiculous.

The male driver was at fault here. I'm sure the mother didn't intentionally have loose straps on the baby. She lost her child because the guy was going 94 MPH and driving like an a-hole.

I am pretty appalled she was arrested for this. It's not like the kid was in the front seat with no seat belt on.

Sounds like a question for an expert witness.

ETA: Also curious what sort of vehicle they were in, considering there were 8 passengers according to the article. Was someone just holding the car seat because there wasn't enough room?

If he was going 94 in a 55 and she did NOT have her baby's car seat latched/secured, he should get Vehicular and she get Negligent homicide respectively.

Not sure Louisiana has that law for just speeding though. It should

Im just saying I want to see exaclty how "ill fitted" everything was. If it was out of control messy/unstrapped, I am ok with this. If it was 1/2" too high based on an owners manual, I am not


As a parent, I am pretty sure 99% of the time your child seat could fail the actual precise protocol considering your toddler is a tyrant and moves like crazy in that thing

Does anyone honestly believe they would have arrested a soccer mom for this? This will be an even bigger joke when the DA refuses the charges. I am betting the police didn't consult the DA prior to doing this.

They might have some evidence that we are not privy to. But what pisses me off is this LSU law professor Ken Levy saying it might be about race.

Exactly.

The driver of the vette is at fault but the driver of the other vehicle is responsible for all passengers in their own vehicle which had too many people to have the child properly secured.
