The placement of the shots shows he almost certainly did not have his hands up.

If aiming for the trunk, you could easily hit the arms if they're by one's side. Not easily if the hands are up.

In the video, the black guy who saw it said MB was in the truck (assuming police SUV) and ran. Cop jumped out and yelled "Freeze!" MB stopped, turned around, and charged the cop.

Witness saying he turned around to surrender vs charge the officer will be the key sticking point

No Confusion - witness said shot in the back he was not.

Further getting 4 shots in your arm in the I surrender position is virtually impossible.

This is done in terms of those arguments

Consistent with witness statements (including local witness who was captured on video explaining what he saw) Cop tried to warn him several times by firing warning shots, the kid kept running at him and then cop fired at his arms/legs, and the kid kept coming at him thus the head shot put him down. I think the Cop acted in the right manner based on what has been presented thus far. Also consistent with someone on PCP as per some reports.
