Sean Payton also confirmed it was a .45 caliber handgun. I need more information but as more and more pours out I'm starting to think the 2nd degree murder charge might be inappropriate and that a manslaughter charge is closer to reality.
Also a witness to the incident confirms on video that Smith said he had a gun. Sad situation all the way around.

Saying you have a gun does not mean you are subject to being shot in the back for no reason other than having a gun.

I could possibly see manslughter with one shot. I can't see it with multiple shots, multiple victims, and multiple witnesses.

6-8 shots fired could timing-wise take between 2 to 3 seconds based on this report by a Police Officer publication. Also the wife was an innocent bystander hit by stray bullets. Still a lot more that needs to be vetted out but right now I'm leaning on manslaughter.

The entire story is very strange.
So, Hayes was hit and run rear ended earlier (not sure where or when) and thought Will Smith's/his vehicle was the culprit. He follows him to get the license plate number and calls 911 to report the accident. He then rear ends Smith at the scene of the murder causing Smith's car to hit an Impala which happened to have Hayes' friends as occupants. Where were those folks during all of this? Where was the Impala at the time it was hit? Parked? In front of Smith?
One article indicated there was more than one vehicle in Smith's "party". Who was in front of or following Smith?
Hayes is shirtless and allegedly freaking out on Smith or was Smith freaking out on Hayes? I'm not clear on where they were at the time. Was Hayes at Smith's car? Did Smith get out of his car and then get back in or attempt to get back in?
Smith may or may not have told Hayes he had a gun. Hayes, then, allegedly says he has a gun, too, and starts firing multiple shots. Don't know how many or exactly where each shot was, but Smith was killed (shot in the back and half way in and out of the car??) and Smith's wife was shot in the legs (multiple times??).
Then, what happened? What did Hayes do after shooting? Were the police arriving right then? Did anyone attempt to subdue him at all? Where were his friends in the Impala? Where was Hayes' unidentified passenger? Any witness statements about what happened immediately thereafter? Did Hayes just stand around waiting on police?
Could Smith not leave because he was blocked by the Impala? Hayes' car should have been behind him since he was rear ended by Hayes.

This is a confusing set of facts, but maybe y'all have the answers to some of the questions.

lester is about the only one in here not showing bias. I understand this is a saints heavy board. But just because he was a former saint doesnt mean he was totally innocent here. Now he may be, i dont know all the facts. But neither does anyone else in here.
