okay, let's say the girl was convinced the 40 year old was going to marry her and drove a getaway car? SHoudl she be charged as an adult to the accomplice to robbery?

I don't think a 13 YO should be tried as an adult. I remember being a stupid 13YO, I didn't understand things like I do today

Keep trying to change the scenarios to make your point... it's not relevant.

The decision to kill vs being manipulated into sex/criminal activity is totally different.

Next, you'll say, "What if the 13-yo who committed murder was seduced into doing it.". I'd say you would need proof and a seducer and it wouldn't be first degree at that point.

I think there needs to be a new set of guidelines for the young and dangerous. Obviously a 13 year old is not an adult; however, how can we protect society against and rehabilitate someone who has already committed terrible acts as a teen/child.

Murder & statutory rape are not in the same ballpark. A kid making a stupid decision to have sex at an early age with an adult who is lying to them is NOT the same as a kid deciding to murder another human. The thought process of those 2 acts do not run parallel so the legal & moral process should not be the same.

I wouldn't press charges because he wouldn't do it again. he would take a beating to make him rethink his whole life.

As for the original question posed, yes, any murderer should be tried as an adult especially if it was cold blood.

I think the details and circumstances of the murder are of the utmost importance. If premeditation, detailed planning, etc are proven, I wouldn't have an issue with it.

Jesus fricking Christ people, can you not logically think? He's obviously saying that if it's OK for a 13 yr old murderer to be tried as an adult, then why don't we look at another 13 yr old that has consensual sex with a legal adult as an underage person just because she didn't commit the crime. He's asking whether or not the 40 yr old should be charged. In one hand, we've acknowledged that a 13 yr old murderer, being tried as an adult, is capable of making his own choice and will be prosecuted in such a manner. That sets the precedent that 13 yr olds are mature enough to make their own decisions, so why charge a 40 yr old man with rape when he had consensual sex with a 13 yr old girl when we have already established that 13 yr olds are capable of making their own decisions with the murder case. This is not that hard.

Now, I don't necessarily agree with it. I think a 13 yr old murderer should be charged as an adult. I think any man that has sex with a 13 yr old girl is a pathetic piece of shite and should be charged as a pathetic piece of shite. That doesn't necessarily mean that I think the girl was raped.

This topic hasn't received nearly as much research as it should, but based on the studies conducted, minors receiving harsher crimes tend to have a high rate of recidivism.

How do other first-world countries around the world treat such offenses by minors?
