I don't think the argument is as bad as people are making it out to be. But, at different ages, different things feel right and wrong. You don't just all of a sudden understand all the repercussions of your decisions. At 13 you should know killing someone is wrong but you might not understand sexual emotions.

The 13 year old girl, if she were my daughter, would still be partially at fault too and I would punish her accordingly but the man should be punished accordingly as well for breaking the law.
Pretty simple "dilemma".

Honestly, you're insinuating that if a person believes a 13 year old should be tried as an adult for murder, then you should also believe that a 40 year old who sleeps with a 13 year old should be exonerated IF the child did it willingly.
That's one of the dumbest sentiments I've ever seen. Ever.

Agreed. Most 13 year old children that murder probably shouldn't be tried as an adult.

Just read the edit, that scenario doesn't even deserve contemplation because it makes no relevance to the original question.
Basically it comes down the the 13 year old in one case committed a crime and the 13 year old in another case did not. The 40 year old man committed a crime. The people that committed a crime should be punished by the law. The one who did not commit a crime but did something incredibly stupid should be punished by their parents. Again, pretty simple.

So you won't answer the second part? If the 13 year old murderer should be tried as an adult because he bears adult responsibility for his crime, why not the 13 year old girl who was seduced and helped with the robbery so they could marry?

No the 13 year old should be forced to military school and get resocialized its the only solution. He should also be constantly reminded of what could have happened and that he was lucky as hell to get a second chance.
