Wouldn't first degree mean that he went there with the intent to kill her?

Dude deserves to go to prison, but doesn't seem like 1st degree is the right charge

I think a lot depends on the state, since there appears to be a lot of distinctions from state to state.

That said, 1st degree murder usually is differentiated from others based on intent and premeditation, but those do not have to be some elaborate plan long before the murder is committed. Makes it easier to prove, but intent/premeditation can often occur pretty instantaneously and right before the murder is committed. Like someone saying “I’m gonna shoot you in the face,” and then shooting someone in the head is probably pretty strong evidence of this.

1st vs 2nd degree in many/most States has to do with aggravating factors.

Generic murder is 2nd degree and a list of aggravating factors elevate it to 1st degree

E.g.
Age of victim
Multiple victims
Murder during the commission of another heinous crime
Murder for hire
Etc.

Not necessarily and in the case of Illinois it is not required. Homicide laws vary significantly from jurisdiction to jurisdiction. Your understanding is true in some jurisdictions and is bolstered by the fact many if not most legal TV shows and movies used that definition. Generic homicide laws are generally useless.

This is where I am. Like even if she was legitimately threatening dousing him in boiling water, the first instinct shouldn't be to kill.



Not saying it wouldn't be dangerous and the cop shouldn't protect himself, but a close quarters headshot is a crazy way to go about that.

There is this weird kind of “ Risk Formalism “ that has saturated our Institutions and our thinking. It is an elevation of the letter of the law over the spirit of the law. 25 years ago personal discretion was more prevalent. But this guy believes that if he faces any risk he faces imminent harm or danger and that’s just ridiculous. It’s almost like he flipped a switch that instantaneously had him thinking if there is any risk I have the right to kill her. Which is scary AF. That poor woman stood no chance because that guy has some weird rigid authoritarian psychology and felt like he had legal cover in the moment to blow her away. When any other 3 people on the planet could have easily diffused a very minor situation.

RIP to this woman. She did not deserve that.

He knew he was cooked as soon as he pulled the trigger. His partner, who knew his body cam was rolling, was smart enough to not say a damn thing, and not affirm any of the shooters justifications.

I saw a new video today that shows she did let go of the pot and she had her hands up with the oven mitts.



the pot was greyish? the mitts are red.



again pot is down. mitts are in her hands. her hands are up.



clearly she is holding up mitts and going down to the ground

the cop who was the shooter was a fricking liar.

at least that other cop actually showed emotion after it all unfolded. he was visibly shaking on his cam at his car.

the other cop just lied about it.
