no relation, and that's exacty what happned.
Did he pass on the shoulder....yeah..but that alone isn't the issue. It's when he was getting back into the lane that either he cut too early, or the other angry driver surged to cut him off and hit him.
Innocent until proven guilty right? Who made contact?
Did he cause his vehicle to spin out of control or did the other driver cause it to occur?

Those sentences were far too light. Had they been firing guns and killed five people they would have gotten lengthy jail time.

This was a civil trial. Both were previously found guilty of vehicular/negligent homicide. This trial was about assessing civil liability, to which Judge Morvant gave each 50%.

Each side's accident reconstruction expert blamed the other. Witnesses say they were both taking part in a cat-and-mouse type road rage situation. Based on the (very) limited information given to us by the article, I'd say Morvant was fair in his ruling them equally liable.

They each blamed each other and witnesses stated they were engaged in road rage back and forth. The fact that 5 people were killed is awful. The fact that their irresponsible and despicable behavior killed those 5 people makes them culpable. Kids or seniors, it doesn't matter.

That's what raised my eyebrow about Marionneaux taking this one to trial.
Marionneaux is no fool and he doesn't work for free so we can assume there's money there.
Also, 8 years prison for FIVE counts of vehicular homicide is pretty lenient. Maybe since it's now a crime of violence that's the sentence range we'll see more of.

There is some money to be gotten. Leger had been an engineer that worked all over the world in oil and gas. Also, he did not spend a lot of money.
This case was crazy. Trudy White acted very improper, and she was reused from the Leger's criminal trial. Also, I think he initially got a mistrial after Boren took over.

Is there "bad faith" available in Louisiana in this situation? Maybe the bodily injury carriers failed to timely tender their limits since both were blaming each other and now they are each on the hook for 50% of the award. The article says experts for each defendant testified against each other.
Or maybe they had a stipulated damage agreement or a high low agreement before trial and wanted to see what the fact finder would assign for liability percentages.

The OP forgot to mention this part.
So the driver is serving eight years for this. Why do you care whether he wants to admit fault at a civil judgement?
