If scott truly had the taser in his hand and truly did shoot the officer with the taser....then I would be inclined to think that the cop was acting in accordance with his own safety.
I read the link you posted and it makes a convincing argument, but I still cannot tell if Scott really did have the taser.
If he did. Cop is not guilty of anything.
If scott did not have the taser.....cop should be in jail for life.

Even if Scott shot him with the Taser or the officer thought Scott was getting away with his Taser, I see no reason to shoot the man once he is leaving. I can understand pulling your weapon during a struggle, but if you go to fire a shot and he's leaving at that point, you're in the wrong, or at least you should be.

It all comes down to this. He was justified to shoot when his brain said "shoot that guy" and he started to draw. You can see in the video he starts to draw while the guy is facing him. For some reason I can't fathom, he never resets his decision when the guy turns to run. It's like he is stuck on that decision and just continues to fire. For that reason, I think a crime occurred.
If he had popped off one round and said "Crap, I shouldn't have fired", I would be sympathetic. But the totality of it is just too much.

Agreed. I understand his initial decision, but at what point should you stop and gather yourself?
Those who justify it seem to believe if you're justified to pull your weapon, you're justified to shoot until he's dead. I don't see how a rational person can see the video and believe it is acceptable. Whether or not Scott had the Taser OR shot the Taser doesn't change anything for me.

The ability to make that decision to shoot, the ability to reassess that decision and stop or not act at all are what police are trained for and paid to do. THIS is the essence of why not just anyone can be a law enforcement officer. You have to be willing and able to make those decisions and then explain why you did. This guy made the wrong decision (IMO) and then his explanation largely consists of "I can't remember." That really shouldn't fly in a criminal prosecution.
Of course, that is what every President and Congressman says under oath so I guess he learned from the best.

Shooting someone while they're fleeing, to me, is an anger response, not a defensive one. Not to say those two couldn't align at the point he began the draw, but the continuation just doesn't seem like the response of someone who actively felt under threat. It seems like the response of someone in an intense situation who was outraged at Scott's non-compliance and couldn't regain his composure in time.

Yes actually. I wouldn't leave it laying across the lot from me where someone could pick it up. I also wouldn't put a piece of evidence back in my holster. The taser got treated the same as if the guy had a gun. I would want it secured where I could protect it but I wouldn't want it on me.
TO BE CLEAR, saying that it makes sense to me isn't the same as saying I think it is a great idea. I just can see where he was going when he said that. Of course, he can't remember anything but remembers that. That is an issue for me.
