Shooting someone while they're fleeing, to me, is an anger response, not a defensive one. Not to say those two couldn't align at the point he began the draw, but the continuation just doesn't seem like the response of someone who actively felt under threat. It seems like the response of someone in an intense situation who was outraged at Scott's non-compliance and couldn't regain his composure in time.

WINNER! Manslaughter conviction. Prosecution screwed the pooch going for Murder here. I 100% believe if they had gone Manslaughter from the get-go, this guy would be sitting in jail right now. For murder, you have to believe the officer said "frick it, I am going to kill this guy even though I know it's illegal." It is hard to get a jury to bite on that. But showing that video and saying "this guy lost his cool and shot someone" is a pretty easy case to make.

TO BE CLEAR, saying that it makes sense to me isn't the same as saying I think it is a great idea. I just can see where he was going when he said that. Of course, he can't remember anything but remembers that. That is an issue for me.

Fair enough

Eta I believe if not for video evidence the officer might have remembered everything and his account would be lies.

Why is that funny? Slager had to believe that Scott either already shot him with the Taser and was running off empty handed, or Scott hadn't shot the Taser and was running away with a Taser in hand. How are either one of those punishable by death once he takes aim and Scott is 10+ feet away and running away?

Police are trained to act with deadly force if their taser is stolen.

I can't seem to find anything that suggest that is the case.

Shooting him while he struggled for the Taser is acceptable IMO. Shooting him while he's aiming the Taser at you is acceptable as well. Shooting him as he's running away, Taser or not, is not acceptable to me.

Raining in N. Charleston currently, reducing the chance of rioting, though I don't think there will be any anyway. Still, gun in my car just in case.

Looked to me when he pulled his gun and got off the first round the suspect and the taser was pointed at him (the very first frame of the video on the previous page) the issue is the shots he took after he dropped the taser and turned to run, as a trained officer he should have reassessed the threat and not fired at his back but that's easy for someone not in the heat of the confrontation to say afterwards. He says he was still in fear for for his life and still shot after he turned and apparently at least one juror believed him. Manslaughter charge from the get go may have resulted in a guilty verdict but whats to say the first shot while he was facing him wasn't the fatal shot? To go for murder seems like a real reach and probably doomed the trail from the get go.

The jury makeup was 11-1 white. Has the race of the holdout juror been revealed? What if the the African American juror was the one who voted NG?

Apparently the jury foreman was the black guy, and he wasn't the one. No, the holdout was a Caucasian good ole baw. It's just a mistrial so the state can (and surely will) try the cop again.

Gotcha. Thanks for clarifying. They'll most likely re-try him. The state might wait until after the Feds get a crack at him.
