Correct. Just look at the menu and see if it is listed as an automatic add-on charge. If so, make a decision to stay or go. If not, tell them to take it off. If the manager comes by to argue the point, tell him that you also have an unlisted 22% patronage charge so the two charges are a wash.

If the server is too pussy to inform me at the front end that there will be a fat service charge added to my bill then that's too bad for them.

Been seeing higher prices, smaller portions and some mandatory min. tips at some places lately.

Also it seems like less people are eating out.

With expenses and operating cost up, it doesn`t look too good for the restaurant business.

That server will sure as hell complain to their boss and maybe things would change. Restaurants are in a shitty position lately with wages going up and costs going up, but surprising people at the end of their meal with a 20% add on is insanity.

Waiter should find a new restaurant to work at if the service fee doesn’t include the tip. Because I guarantee almost everyone who eats there is assuming that the service fee is just an automatic gratuity added on the bill. So he’s going to get screwed out of a lot of tips

ETA: with a large group, it probably was for automatic tip though

If I saw 20% added to my bill I'd assume that's what it was too. It's not a normal thing people are used to. I'd rather them just raise the prices 20% than essentially charge hidden fees.

Picked up a To-Go order from a Baton Rouge Chinese joint. My wife had ordered using a menu I had picked up in December.

I go in and it was $65 for 2 people. Stunned I said that’s nowhere near what I saw on the menu. He said they don’t print menus anymore.

You have to scan a qc code to get the menu as prices are updated all the time. Or look them up online.

Nah. I’m getting over eating out very fast.

Servers quit and go elsewhere. Scummy restaurant owner shuts down. You liberals always expect someone else to foot the bill. We're fricking over it

OT lawyers: what are the rules for this? Do they have to tell us beforehand or are they allowed to rob us? If the latter, is it class action lawsuit time?

Its tipping at a restaurant in America. It just the social norm.

Also, just dont go back to the restaurant. I understand the anger, Im not going back to a place with a default 22% service charge.

But Im not going to stiff the waiter cuz im mad at the owner.

The wait staff needs to let the customer base know WTF is going on if the 20% fee wasn’t listed somewhere on the menu.

Not a lawyer nor would I sue over that. I just wouldn't go back.

My guess is it's completely legal but I think it should be disclosed upfront. Hotels, rental cars, concert tickets etc charge more than the advertised price + sales tax. Have you ever wondered what a "convenience fee" is?

Just got back from eating out and there was a 3.5% “dual charge”. It was a add on credit card charge of an extra 3.5% added to your bill.

I usually tip 20%, we’ll because of that I just tipped 15%.
