This is from a friend of mine:

quote:

So this happened two weeks ago. If you heard about the "CATS" bus hitting the house on North Blvd... well it hit me, head on before crashing into the house! I didn't post pics, because we were hoping CATS would do the right thing and take care of business by simply replacing my totaled car. This doesn't seem to be the case and they haven't even paid for my rental which was promised at the accident scene. CATS is protected under law where if the damages exceed $10,000, they can choose to pay out quarterly. They don't even have to deal with me until the end of June. Further, they can actually pay me over the course of many years if they choose to do so. I pay my taxes, run my business, keep insurance to protect myself and others in the event that I harm someone else. Yet, the same government that requires me to pay others that I harm is immune from paying those that it harms. This is Louisiana politics at its best. The state and city officials that run the government certainly haven't missed a paycheck yet they are "held harmless" for their haphazard and irresponsible actions.

Is CATS not self insured and have to pay out immediately or close to immediately in the case of damages? This seems strange.

Have him call Dudley-DeBosier. The number is on the bus that hit him. He couldn't miss it.

Yeah...BR doesn't have to pay anything...but it does. I read every city council agenda. $75k damage for a sewer backup?

You're surprised that the government makes itself immune from its workers frick ups?

They are also protected by “Sovereign Immunity”. But any settlement will have to go to city council. Will take at least a few weeks.

They usually handle property damage separately and pay for it quickly but any bodily injury settlements/judgments are put into a pool with all the other settlements that are paid out quarterly.

CATS is an embarrassment and the epitome of our city council's decision making capabilities.

I pay $200 a year in a tax for this bus that doesnt have a stop within 3 miles of me...

Trying to move out of this hell hole soon.

I stopped at Cortana Mall the other day to pick up Chick Fil A from their limited food court.

I counted 9 CATS buses parked there waiting for riders. NINE.

I regularly post about the times when it is wrong and immoral to sue. But there is a time and place for lawyers and civil lawsuits. THIS is one of those times.

I can tell you this from experience, they won't take you seriously until you have an attorney contact them. But here is your problem, any lawyer that takes the case will take it on a contingency. That means that it is in their interest to drag this out and maximize the suit so they get paid more. They won't be interested in a quick cheap settlement to replace your car. Conversely, the only way to make that happen is to pay a lawyer out of your pocket by the hour to negotiate a quick settlement. In that case, you are the one who gets screwed.

Sorry but you lose out here by being in the wrong place at the wrong time. Unless you drag it out and sue the hell out of the Parish in which case I get to pay you with my taxes.

Damn, now I am the one getting screwed.

It's a bit ridiculous. CATS former CEO kept giving himself pay bumps and then resigned. And we're stuck paying for it.

If your buddy has insurance like he claims, he should file through them, pay the deductible, then have the company subrogate against CATS.

He will be temporarily out of the deductible, but his insurance will pick up the rental.

As for personal injury, like others have typed, hire an attorney.

My buddy worked for the accounting firm that audited CATS. He told me this years back, but I didn't believe him.

I imagine you would find it interesting the top 8 Maintenance employees made a combined 600k last year, not including take home company vehicles and fuel cards.

That doesn't include the other 20 or so mechanics that average in the 50k range.

1.5 mill in payroll annually......just for the people who worked on that bus.

Lawyer up. If you don't like the settlement lawyer up. If uyou don't like what the insurance people tell you, lawyer up.

CATS will settle.
