If he was fleeing police custody during the commission of a violent felony, they can use deadly force, and they should.

What if this kid popped off three shots, ran, the cop didn't shoot him bc his back was turned, and the kid took a hostage or killed someone else in the meantime? You don't want the cop shooting him in the back?

Damn, lol. fricking Texas. What if they're just running because you have a gun and you think they stole something but didn't?

This is a rabbit hole and I'm about to leave work so I won't go further down it. I think that is screwed up to shoot an unarmed person in the back in this situation as they run away.

Well in this case he would be armed...

Does the officer have reason to believe he's unarmed? If the kid fired off shots, he could still have the gun on him. Officer can't afford to assume he doesn't have it.

Yeah where we can protect our property.

quote:

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY.

A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41; and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means; or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

To be fair, they didn't know if they were involved in the shooting. Witnesses stated they saw the vehicle speed away from the scene, not that somebody in the vehicle committed the crime.

How do you know he is armed? Because reports of gun shots?

And I'm sure the officer could at the very least see nothing in his hands. I understand it could be in his waistline, but that is a strong assumption to kill someone over.

I'm not really sad for this guy that died, seems like an idiot that added nothing to society but harm, but shooting someone in the back as they flee when they have nothing in their hands is a really bad fricking look.

You said there is never a reason to shoot a fleeing unarmed person. Period

You extended way past this case with that statement

According to you, a person could shoot at officers in a car chase, stop the car and run out towards perople and you would say the cop shouldn’t shoot if the suspect happened to leave his gun in the car ......,

I'd like to see bodycam footage, but yeah, the phone video does not look good for the cops.

I love the bolded part.

Let's check those public records of how often, or percentages, of stolen goods are recovered and returned to the rightful owner. I'm guessing the stats bear out, shoot the guy if you want to keep your stuff.

In Texas, if someone wants to stay alive they should: A) not mess with other people or; B) not mess with someone else's property/stuff in Texas.

Fair, and I guess I mean if they know they're unarmed.

In this case, he clearly has nothing in his hands and the cops do not know definitively if they were even involved in the shooting, correct? I'd argue far more people that run from the cops are unarmed than are armed. We can't let cops just guess who is and who isn't when they can't see a gun and have no proof they committed a crime.

So the cop had a hunch he might be armed, even though he could not see any weapon and has no idea if they were involved in the shooting, and then shot him in the back as he fled?

That's a bad look.

He’s driving away from the scene of a shooting, has 2 guns on the floor of the car, and jumps out running away. I think you can put 2 and 2 together to determine he was the shooter.

Granted they found the guns after, but still. Nothing he did indicated he wasn’t a part of the shooting.

Nope, they definitely shouldn't shoot if they know for a fact the guy isn't armed. That's what I mean. I understand what you mean when you say they didn't know in this case, but they clearly didn't see a weapon and had no proof he ever had a weapon in the first place and he was not running towards other civilians, he was clearly fleeing.

And in this hypothetical they prob shouldn't shoot because he's running towards people and that would be dangerous
