Go through PTI if it's his first offence. You don't need a lawyer for that.

I’ve sat in traffic court several times and watched people with DWI offenses get PTI, litter pick-up & a fine. None had lawyers for that.

It’s not incorrect, it is correct.


You can request a hearing to get a hardship license which allows you to drive to/from work, school, medical, etc. but your license can be revoked if you’re caught out driving on the interstate at 2am or something. The hardship license isn’t guaranteed though.

It is best to get a lawyer. If he tries to represent himself he is unlikely to get off entirely. The best he can hope for is to get to plead under CCP 894 that allows that will keep it off of his record. Sometimes this is the best a lawyer can do anyway. If this doesn’t work, get a continuance and hire a lawyer.

The advice to never blow doesn’t always work these days. If you refuse to blow, your drivers license suspension time doubles and the cops can subpoena your blood sample anyway.

I'm no expert, but I'd suspect your odds of getting off are better than someone who blows into the device and is over the legal limit?

You should ask the officer if you should blow or not and THEN determine if he has the best interest in your decision.

Glenn Delatte specifically tells clients not to even get out of the car and crack the window to talk to the officer. If he wants to bring you to jail then so be it but do not give them anything

Odds are his lawyer will go through body cam footage and police reports with a fine tooth comb looking for a technicality.

If he didn't blow and had a lawyer he could get a also on the wrist plus only loss of license for a while.

While PTI has its place, most people don’t realize that, while a dismissal can be expunged immediately, a dismissal pursuant to PTI requires you to wait five years before filing for expungement. That matters to some people.
