I guarantee you this guys plea will become normalized

I think his argument (at least from what I gather) is that he has the urges of a 9 year old, not necessarily the mental capacity of one. I suppose it's no different than a man who thinks he's a woman who still has male urges.

do you have a link?

So, how does this man not have a right to be viewed as a 9 year old by the law?

the law can view him however the law wants. I do not believe this is something that would fly in a court, though. I didn't go to law school and I could prosecute this idiot.

1st argument is the average age of puberty in males is 12-16 years old. By that logic, a 9 year old shouldn't have even had these urges.

well then 9 year old can still commit crimes. And if it is just "urges", then that doesn't help his argument to be tried as a juvenile.

I highly doubt it.

your average 9 year old male doesn't have sexual urges like this. If anything they are acting on curiosity. No way in hell this argument would fly in court.

I'm sure they can. There may be a limit though.

The point here though is how can one be consistent if they argue that someone can be treated as a woman because they feel like they are a woman, even if they aren't, but then argue that this man can't be tried as a 9 year old because he feels like he is one, even if he isn't?

You sound like you're dangerously close to being on the wrong side of history

It will be used as much as the insanity plea, which is less than 1% of cases

I mean, for one it's not as if it's happening daily. I guess we will see how this one plays out.

basically the only way this defense works is if he can prove he has the mental capacity of a 9 year old

that's just naivety.

A lot of the stuff that's normalized today was laughed off a couple decades ago

It will happen very soon. They'll fit under the "big umbrella" somewhere

again, treating someone as a woman in daily life is not the same as in a court of law.

you'll need to find someone much farther left than me to argue this with. Because my views on trans is simple. If they want to wear women's clothes, use the women's bathroom, etc...fine. But as soon as you decide to abuse that flexibility afforded to you, all bets are off. And I can say that because I truly don't believe your average tran is really a straight bro trying to get his way into the women's bathroom.

If someone wanted to be tried as a woman, how would that work?

I have no idea. Is criminal law that different for women?

That's fine. I don't disagree.

The question then becomes, do you think a non woman, should be allowed to be tried as a woman in a court of law? If the answer to that question is yes, then you should allow this man to be tried as a 9 year old.
