OT lawyers ...need advice...real estate related UPDATE page 5

In September of 2017 I took a job transfer. I couldn't sell the house so the company's relocation service bought it. The issue is that the title is still in my name. It won't change names until it is sold. The HOA won't give any information regarding payment to the relocation company. I've sent them the bill of sale, the POA for the deed, my job offer acceptance and relocation details and they still won't quit.

The HOA president has accused me of bullying him because I keep telling him I'm not paying a dime, I have no interest in the property and to provide billing to the relo company.

The relo company recently paid the dues, and this douche sent me a bill for the interest on a late payment. I forwarded the bill to the relo company.

He has got his lawyer involved and is threatening to put a lien on the property. I told him the dues were paid and he can't put a lien on anything and any lawyers fees would be frivolous.

Can I file harassment charges against this a-hole? What do I need to do to get him to stop?

Hire a lawyer to write a letter. Not fair, but it's wise. Your lawyer will tell the HOA to contact him/her in the future and not you.

Just ignore him and let him put a lien on it. We can’t be talking about a lot of money here. And the lien will be paid out of the proceeds at the closing once the relo company sells the house.

Why risk having a lien put on it though? The OP should deal with the relo company. The HOA is in the right here. They only have to deal with the person who holds title.

So why are you fighting it? Pay it and deal with the relo company for reimbursement. The HOA guy sounds like a douche. Don’t provoke him.

I'm going to guess here...

If you own the property then you agree to the HOA rules

Rules state you owe certain dues

Pay those dues or HOA can file a lien

How much interest are we talking? They won't file a lien for a minimal amount.

What does it matter? OP already has his check. Let the relo company pay the lien at closing.

The relo company pays and the HOA cashes the checks....the part I'm worried about is how much legal fees he tries to apply to this. I just don't pay the lien, I'll let the relo company deal with that too...I'm never going back to Indiana

That’s fine. Better make sure your contract with the relo company is sound. Again, title is in your name. You’re on the hook for everything.

All the lien does is prevent the sale of the property without paying the money first..

Either pay it all yourself and get reimbursed by relo company

Or

Roll the dice that relo company pays it eventually and hope it closes

They arent filing a lien...

Eta:. Pay the 10 bucks and get on with your life...why are we debating this?
