Background: I am in the Air Force and I have orders to move to North Carolina. My wife's ex husband waited to the final hour to contest us taking my step son to North Carolina with us. So at 4:04 pm today we get an email saying we have to appear in court at 9 am tomorrow because he's contesting the relocation. So my question is, can this happen? And what exactly is he doing? Per the courts he has 30 days to appeal and we notified him on 28 August that we're moving... Today is day 32. He's a single dad also in the Air Force. He has no family in WA. It was so late we can't even contact my wife's lawyer. She has majority custody and in the divorce dicree if she moves over 2.5 hours away everything defaults to the mother. Nope, we did not know about this until tonight. We tried contacting the lawyer and couldn't get a hold of him. So they basically gave us 14 hours notice we had a hearing. And the email had my name spelled wrong... Header had Wiley... This makes no sense to me and I've seen people in the past get good advice but I guess tonight was a bad night haha.

My ex wife is getting served papers today can't wait for the phone call today. Divorce can be a pain in the arse. Try and be civil and there is always one that can't be. I tried the civil way but oh course she wanted to go to court. Sorry to hear about your issue. Good luck

Then you should know that I didn't want until the night before when I was notified the night before. This isn't the only place I asked this advice, we've reached out to a few people but so far no one can help us. And how are you automatically assuming I'm dumb and bad shite happens to me?

you've actually gotten good advice in this case. You have 14 hours notice, go to court tomorrow, tell the judge that, file for a continuance on the case due to not having adequate time to find proper legal representation.

Also, if the email isn't from the court, I wouldn't even worry about it. Did you have a read receipt with the email? Youre supposed to be served by a constable

This reminds me of the episode in season 2 of the wire when the union guys prank Ziggy with the fake letter from the lawyer regarding a DNA test for paternity of the neighborhood jumpoff

Pay for your own legal advice, Jody.

Exactly. Please tell us that the guy wasn't overseas when you started banging his wife.

The father has every right to his son. Moving on the other side of the US is not the fathers problem. If the father filed an appeal within 30 days and it wasn't served until day 40 doesn't mean it isn't valid. Be prepared to have the son stay in WA for awhile.

ETA. If service papers on custody have been filed and the parent knows about them but ignores them it could be contempt. For instance, if a restraining order is filed and granted by a judge a person can violate them even if they have not been served, IF they have knowledge of the order. It really comes down to the situation and the judge.

Agreed. Put yourself in his shoes for a minute and cut him some slack. Unless he's a douche.

Apparently you're not a fricking reader, you fricking douchebag. He didn't get the notice until 4 pm today. So, not a big fricking issue that he brought it here a handful of hours later.

If you have nothing constructive to add then why open your fricking mouth in the first place?

Nighttime OT is largely Internet trolls and scumbag liberals. You've identified yourself as military, so you should expect scumbag liberals to go out of their way to attack you. You're on the internet, hence the internet trolls. FWIW, If they all spontaneously combusted in an AIDS dick fueled fire the world would be a better place.
